Roberts writes the 5-4 decision: "Here the agency failed to consider the conspicuous issues of whether to retain forbearance and what if anything to do about the hardship to DACA recipients." The case is remanded back to DHS "so that it may consider the problem anew."

This outcome is similar to what happened in the census citizenship question case in both cases, Roberts wrote for the majority of the court that the Trump admin *could* in theory do what they were trying to do, but that officials had gone about it in an unlawful way

What did you want the officer to do while Brooks was beating them up?
Brooks had the taser and tasers have killed over 1000 people in the last 3 years, so it is a deadly weapon.
The officer should have told him, wait, I want to get my gun out and shoot you now before you get away after you have beat us up tried to hit one of us with the taser.
YOU HAVE TO OBEY THE LAW.
In one video I thought I saw one officer stop at the car when Brooks fired the taser, just momentarily.
Was he hit with the taser?
I do not know.

Good video for a summary of the overall incident except for the pause for commentary during the critical seconds of the firing of the taser and the gun. Does this pause make it seem that the policeman had more time to decide his actions than he actually had?

I’m not a cop, never was & never will be. I am not a lawyer, never was & never will be. I am not an expert on the Atlanta police department, never was & never will be.
As I mentioned, IF the cop had shot him during the struggle or even at the point where Brooks reached back & fired the taser, I feel he would have been more justified.
My opinion from what I have heard & read
First of all, the police use the taser, but say it is non-lethal. When the suspect has the taser, it is now deemed lethal. Either it is non-lethal, or it is lethal.
The taser had been fired twice & apparently, it only has 2 cartridges, so even if it is lethal, it was out of “bullets” or the capability to further function as a weapon.
By time the cop ran/stumbled into the red car and dropped his taser, Brooks was running away. From what I understand, a functional taser has a range of 6-10 feet. It looks like Brooks was more than 6 & possibly more than 10 feet away when he got shot. Even if he wasn’t 10 feet away, the cop could have stopped running/pursuing & Brooks would have continued to run outside of the 10 foot range.
Every time I see a police training video, they ask if the the cop was in imminent danger AT THE POINT OF USING LETHAL FORCE. Had Books squared around, even if the taser was empty, and tried to shoot I feel the cop would have been in imminent danger. However, Brooks was running away, and had his back to the cop. The cop shot him in the back. How was the cop in imminent danger at that point? Yes maybe before that point, but at the point of firing his weapon?
I have even seen court cases where a shooter was convicted after having a struggle, shot the criminal & was convicted because the struggle had ended & the shooter was not in imminent danger at the point of the shooting.
Maybe they could have called for back up, a K-9 unit &/or a helicopter and conducted a search after letting Brooks go rather than shooting him in the back. I don’t know, maybe I’m not being realistic.
Again, I am not trying to justify Brooks behavior & I realize he had a long criminal history & was on probation. I am not saying Brooks was a good guy.

Chief justice Roberts is really out for the destruction of America and the constitution. To vote against something that is completely constitutional because he doesnt like the way it was approached or worded or something is just disgusting. So much that is good for our country could have been done in Trumps first two years when Republicans held the House, the Senate and the presidency. Evil Paul Ryan thwarted President Trumps every move.

It looms to me he shot after Brooks fired the taser, after he regained his balance. Yes he did. Brooks reached back (did not turn all the way around) and fired. The officer ducked, ran into the red car, dropped his taser. During the ducking & running into the car, he was simultaneously unholstering his gun & getting it into his hand. After firing the taser while running, Brooks continued to run away.
The cop, after securing his gun, continued to run a few more steps in pursuit of Brooks & shot him.
That's the way I see the various videos.
Taser=shoot a cop and get the cops gun.
Get a cops handcuffs=then take the cops gun and shoot the cop.
Hit the cop with a big stick=then get the cops gun and shoot the cop.
Hit the cop with a rock=and then get the cops gun and shoot the cop.
Conclusion, anything used AGAINST a cop while resisting arrest...is deadly.
