DETROIT (CBS NEWS) — Prosecutors have dismissed charges against a 10-year-old Michigan boy accused of assaulting another student by throwing a ball at his head during a schoolyard dodgeball game.
While the boy no longer faces criminal charges, “the mother of the alleged victim had every right to go to the authorities and the authorities had an obligation to investigate,” Maria Miller, assistant prosecuting attorney at the Wayne County Prosecutor’s office, said in a press release.
Miller’s press release also points out, “When this case was reviewed by my office, no one paid attention the race of either party.” In some reports about the case, critics suggested the charges were racially motivated because the 10-year-old is black and the boy he hit is white.
“It is categorically wrong to suggest that this was charged based on race or geography,” Miller wrote.
Miller’s statement clarified that the 10-year-old was never arrested and that she did not make her decision based on public outcry. She also pointed out there are other options for a juvenile rather than being prosecuted, and expressed hope that both families involved can work out a solution for the children.

Assault? In dodge ball? Isn’t that the point of dodge ball?
Just waiting for someone to bring up the movie “Dodgeball”.
I don’t know the specifics, but it might be a better procedure for the prosecutor’s office to do their investigation before filing charges.
The game of dodgeball has been under the evil eye for several decades now. Yes it’s fun but several states have banned it because the rubber balls do hurt badly if hit more so in the face and kids, well boys do sometimes go out of their way to hit very hard usually on the girls but not always.
When I was in school this was the case and after I left the county made them quit using rubber balls and only Nerf ones. Other states like I said just outlawed the game.
Personally I’m not against dodgeball just use the Nerf balls.
LOL...when I was in my twenties, I was playing dodgeball in a gym and I was the last one in and had people winging the ball at me from all sides, on one I dropped and rolled, ending up face down with my nose against the floor.
As I lifted my face to look in front from the direction the ball was expected to come from, the ball was just a few feet from my face whizzing directly at me at high speed.
I instinctively ducked my head and split my chin open on the wooden floor...:(
To this day, my beard is salt and pepper, but that one area grows in completely white!
It had happened to the other child before and this time the mom pressed charges.
What is going to happen is dodgeball will be outlawed at this school/county.
That school should have switched out to Nerf balls like others did in the 1990’s

10 year old kids.....not supposed to throw at the face.....the victim had a black eye and facial bruising.
I would have brought charges. Now the kid who threw the ball thinks he can get away with doing things that are not allowed in the rules of the game. A bad lesson to learn.

As a kid when we played this game it was a point to make it smart. If I didn’t get an ouch or a angry look back I’d feel like I wasn’t doing it right!
We played hard and rough. King of the Hill on a local construction site was murder. We kept band aid and Bactine in business.
You shouldn’t believe the media at face value.
It wasn’t a sanctioned game of dodge ball, the black kid deliberately targeted the white kid with a dodge ball who has a medical condition. There is a video online.
