I believe coup leaders feel that the DOJ is loyal to them, and anyone likely to appointed from inside the DOJ or from the big lobbyist firms like Kirk & Ellis or Jones-Day will be loyal to the coup as well.

I hope RR really is resigning. Rod Rosenstein was Trump’s worst pick. Sessions turned out to be terrible but his selection was for the correct reasons. RR was from liberal Maryland and part of the judicial cover up of the Uranium One deal.

Who suggested him? It might have been Cummings back when Trump had the Black Caucus to the White House. PDJT thought that he could win them over enough to work together. That did not happen.

RR and Mueller have to answer for Uranium One and for participating in a coup to overturn an election and a sitting President.

Unless he was flipped, RR will retire to Gitmo or another Federal facility.

Their fellow Senator for 20 years, Sessions, was barely approved.

Thus, the Swamp signaled their choices pretty clearly.

I think that a former employee can invoke the Fifth Amendment while an employee of the DOJ must answer questions. Of course he can just say that he cannot answer due to an ongoing investigation, a big reason for the investigation to continue, IMHO
