No court can prevent him from using the military. You guys think because a war takes a long time to win, it is unwinnable. And Trump doesn’t whine and the Courts have blocked his legit efforts.
Article I, Section 9, Clause 7 [Appropriations Clause] "No Money shall be drawn from the Treasury, but in Consequence of Appropriations made by Law..."
The current manner prescribed by law requires ALL money either transferred or reprogrammed by the President to get its approval from the particular committee tasked with oversight of the appropriation.
That's the law.
Saying "the military is responsible for national security and this is a national security issue," while true, is irrelevant. The "military" does not have a $5bn slush fund dedicated to "national security." Any money moved from already targeted purposes would have to go through committees soon to be chaired by Nancy Pelosi's minions, flunkies, and stooges.
The President needs to either stick to his promise to shutdown the government hoping at the very least to embarrass Republican idiots into doing something before the new Congress is sworn in, or accept that he is NOT getting a wall, and that it's his (nominal) party's fault that he won't.
It's 100% Republicans fault. The President stuck his neck out the other day when he claimed he could get immigration reform through the House. He can't. He never could. The leadership wouldn't allow it. Listen to the Freedom Caucus they've been telling the truth about this since day 1.
In the alternative, there IS ZERO legal room to fund any part of The Wall through the military.

Steel slats and lots of razor wire will work. I visit across the border at Tijuana frequently. Remember this, there was no razor wire down there until about 10 days before the illegals stormed the border at the end of November. Trump ordered the military to install the razor wire.
He needs to shut it down.
Not as well down as the CoC/Koch Republicans, who’ve pretended to be for it, but have blocked it for two years.
Like how the courts have stopped him from keeping transgenders out of the military?
A judge from the 9th Circuit Court will stop the military from building a wall before the first shovel.
And that's how Trump wants it, he will then complain at the next rally all about it.

The wall is not going to be built this term. The only options he has is MASSIVE enforcement, communicate to the states that are willing, to form task forces to clean out the illegals (they will then go to blue states), and then put it on the ballot for 2020.
What about the DOD OCO slush fund of $18.7 billion for State Department and Homeland Security to fight ISIS? Why not that?
