This is the question for which I read no answer in the article. Why did the cops take Anna into custody and tell the two guys with her that they were free to go but do not follow their van? The pot was stated to be in the cup holder of the car and not in the personal possession of any one of the three occupants of the car. Yet the cops took the attractive young female, handcuffed her and placed her in their van. They were expecting consent and silence from Anna. She rejected their sexual assault and they got rape charges and unemployment instead. They also deserve prison time as well.
New York state legislature should pass a law closing the loophole that permits cops from claiming consensual sex with anyone in custody and it should be named Anna’s Law.

The law did not and does not protect rape. Period.
Not surprising. What they alledgedly did is illegal because it was rape, not specifically because they were cops and tye victim was in custody . In what case is rape ok such that we they should only outlaw specific situations of rape? Easier to make ut illegal to rape across the board.
OK, the cops didn't want sex with teenage males, OK. Or they didn't want witnesses.
Or, logistical issues: even if they wanted to arrest the guys to put pressure on her to put out, how do they justify taking all 3 of them to the station, processing the guys, and then driving away with her to have sex? (There'd be witnesses at the station that there were 3 detainees, but only 2 were booked, etc.)
I'm not sure whether I'd believe the idea that she offered sex to the cops in return for letting *all three* of the teenagers go, either. And the cross examination is what the feminists claim happen to ALL rape victims when they press charges.
Where's the feminist outcry on this one, btw?

The person(s) (in this case cops) is in a position of power and authority that inherently provides a very potent level of intimidation and force that should NEVER allow any type of sexual contact - PERIOD!
Just like jailers and prisoners or teachers and students - cops and detainees whether under arrest, under detainment or ANY OTHER PROFESSIONAL CIRCUMSTANCE should NEVER be allowed to have sexual contact with a detainee (consensual or not)!
The law protects cops for having sex with someone in their custody in NY. It should be against the law for a cop to have sex with someone under arrest, which it is in twenty other states. Period.

In a prison it is against the law for a corrections officer to have sex with a prisoner. It has been determined that a prisoner is not in a position to give consent to sex to a corrections officer. Twenty states have also extended this law to police officers and to those in their custody for the same reasons. If one cannot grant consent then any sex with the individual is automatic rape regardless of the situation. This is the same as sex with a minor, a minor cannot consent to sex.
Gotcha. Basically they are making the argument that while on duty they had consensual sex with the girl and then dropped her off.
Yes, without this specific law I can see how they would be fired but not face criminal charges.
I think that, because of the power a badge grants, it definitely should be considered rape if a cop has sex with someone while on duty, if the other person claims it is. The reason is simple: Their badge gives them power to “force” the other person without actually using the kind of force an non-cop can use. i.e. “Would you like to avoid a ticket or arrest? Then come here, baby...”
I’m not married to that position, yet. I’m still thinking it through. But a simple “hey, it was consensual sex” plea doesn’t work. The badge gives them power that can be abused. If it is, they should get more than “fired”.

So the headline is worded in such a way as to invoke outrage by inferring something that is not true, hence my label 'click bait.'
I do not know, but I would not be surprised if the NYPD had rules against having sex while on duty, as a firaeble offense. So it isn't as if a consensual act is without consequences. A non-consensual act already has severe legal consequences.
Think outside the box. If you’re alone, and two cops are approaching with this in mind, get on your cellphone with someone you trust. If you can’t change the law, change the conditions.

However, if we need laws to tell a cop that having sex with ANYONE while on duty is a crime then that’s a problem.

No one who would have sex with someone in his custody should be a police officer.
I hesitate to make any positive pronouncements regarding the frequency of such conduct, as our president has shown me that I was wrong about the level of corruption in the Stupid Party, but I haven’t seen anything to make me think that there are many LEOs who do this (FBI, CIA etc. excepted).
And neither are the stories involving sexual misconduct by those in the sports industry limited to just one. That was his point, there are bad people in every profession. Thus a broad brush should not be employed every time one of those bad people are exposed. Because for every bad one there are more than likely 10 who are good.
