Maryland prosecutors will drop rape and sex offense charges against two immigrant teens accused of attacking a 14-year-old classmate in a high school bathroom stall, according to attorneys in a case that shocked local parents, attracted international and White House attention and stoked the debate about illegal crossings into the U.S.
In court on Friday, prosecutors said they will drop the sex assault case against Jose Montano, 17. On Thursday evening, they told a lawyer for Henry Sanchez Milian, 18, that they would also drop his sex assault case, according the lawyer, Andrew Jezic.

If I recall correctly, this was a particularly vicious rape. Physical damage done to all mucous membranes, orifaces. Damage not done during consentual sex. . .this story stinks of blackmail and payoffs.

The article states the selfies were sent only to Montano who then forwarded them to Milan. This seems to be a pretty strong indication she wasn’t interested in encouraging the older Milan.
I’ll take any charges they file against these two. But it’s bizarre Milan might not be included in the child porn charges when the images were still on his phone.
Unfortunately, the older scum bag is under 4 years older than the victim —just barely under yet under — and, so cannot be charged with statutory rape if the sex was consensual.

No, the legal age of consent in Maryland is 16, but if a teenager of 14 has consensual sex with another teenager, as long as the older teen is not 4 or more years older, it is not considered statutory rape.
Lordy! How did we get to a place at which we are discussing a 14-year-old girl having sexual relations. And what has this child seen that she is okay with a threesome? God help us all.
And her lying about it will make it more difficult for the future unwilling victim(s) of these perverts.

Yeah, supposedly they are also under 18, but, as someone pointed out upthread, who knows how old they really are? Could be in their 20s.
Most states have Romeo and Juliet laws. Usually means that as long as there is not more than four years difference between the students, and it’s consensual, than it’s legal. Over my four years of high school I knew a lot of seniors that dated freshman, and many that were having sex.
It does indeed sound like there is no case, even for “child porn”.
As far as that, yeah, maybe charges should be dropped.
But it doesn’t mean they shouldn’t be deported.
Sounds like our girl was lying. Why? And I never, ever heard a name for her, ever. I’ve wondered all along if she was illegal, too, which would make all the ballyhoo about the 2 boys kind of stupid.
Again, all should be deported. And at the very least, it does NOT speak well to their characters - and how they want a “better life”. Nor does it speak well to “teenage culture” as some idiot interviewed stated, as if hey, it’s just their choice! All lifestyles are valid!
It’s not my world and those monsters need to be deported pronto. Instead, they’ll probably be right back in high school.
