Maryland prosecutors will drop rape and sex offense charges against two immigrant teens accused of attacking a 14-year-old classmate in a high school bathroom stall, according to attorneys in a case that shocked local parents, attracted international and White House attention and stoked the debate about illegal crossings into the U.S.
In court on Friday, prosecutors said they will drop the sex assault case against Jose Montano, 17. On Thursday evening, they told a lawyer for Henry Sanchez Milian, 18, that they would also drop his sex assault case, according the lawyer, Andrew Jezic.

She was just 14 but the guys were also underage so.....
The victims claims could not be substantiated. In fact, some of the things she claimed were contradicted by video surveillance.

In the initial story she was yelling for them to stop as heard by students passing by. Even if she was ok at the start, if she changes her mind it is still rape. I can’t imagine that if this were college it wouldn’t be considered rape. Seems strange the requirement for rape in high school is more.
I suspect the difference is in this case the male is not a member of the protected class.
Exactly. Liberal causes generally go against core principles like natural law, logic, consistency and factuality. They are aimed at motivating voters with niche or group interests, not national or jurisdictional interests. When they compete against each other, the conflict and inconsistency is very quickly apparent.
Under current policy only those illegal aliens with prior removal orders and conviction for other crimes are being removed.
Maybe I should have read the whole thread. Apparently, as others pointed out, there is an exception for persons age 14 to give consent to someone within 4 years of their age. So the case should have revolved around the age these “boys” claim to be and their actual age, which in the case of many illegal immigrants is found to be much higher than they claim. It seems the court in the blue, blue Montgomery county (that abuts the District of Columbia) wants to take the boys’ word for it.
Plus one of the boys was 17

They had very wild 14 year old girls even in my era

Age aside. She may have consented to sex with her ‘boyfriend’. There is no indication she consented to a gang bang. That was a little conspiracy between the two Illegals.

Apparently she agreed to have sex but did not agree to be raped in the bathroom by the two illegal aliens. Prosecutors decided they couldn’t get the rape charges to stick.
BS. They should have gone to trial and let a jury decide.
From John McCarthy, the state’s attorney, confirmed in court on Friday that Montano will be re-detained as a juvenile on child porn charges over lewd images of the girl on his cellphone. Milian will face child porn charges as well. H/T Daily Caller
So they will face charges which are easier to prove (on his cell phone) and will get them jail time - we hope.
The feds could use the child porn charges to deport the suckers — they should be deported on general principle, IMO.

Funny how your 16 year old can’t put gas in his mothers car while your 14 your old can get an abortion or have legal sex and you also are not allowed access to their library list.
We certainly have turned a perverted corner....

Since the rape charges against both are being dropped, it can be assumed that there is not evidence to prove she didn’t consent to having sex with both.
One interesting aspect of this case is that if the girl sent the images—presumably of herself—that form the basis for the child pornography charges, perhaps she could be charged with child pornography as well. I believe two teens in North Carolina were charged for taking nude photos of themselves.
