The former Navy SEAL who says he fired the shots that killed Osama bin Laden was arrested Friday on a drunken driving charge after police found him asleep in a car parked at a convenience store in his Montana hometown.
Customers at the store in Butte called police to report a sleeping man behind the wheel of the running car around 2:30 a.m., Butte-Silver Bow County Undersheriff George Skuletich said. The officer who responded woke the man up, identified him as Robert O'Neill and noticed odd behavior.
"He was confused. His actions were consistent with somebody who might be under the influence of something," Skuletich said.

In my county, you can be cited for texting in your car while it’s immobile in the parking lot.
You cannot be drunk and behind the wheel of a vehicle with the keys in the ignition, much less with the car running. That is DUI.
You’re probably right, but because the car was still running, the police apparently took that as ‘intent’.
I hate to see one of America’s best in a bad situation. Hopefully something can be worked out.
I slept it off one night and they tried to arrest me. Fortunately, I stashed my keys about 40 feet from me so the cops could not find the keys..no dui
they were pissed but it helped to know the law.

Each state may be different but in most it probably would not be DUI. If he had the keys in the car with him it would be “Being in Actual Physical of a Motor Vehicle While Under the Influence”. APC for short. Sometimes the punishment is similar but the stigma is less.
Maybe the car was running, to provide heat, but it was not moving, it was parked.
Right, but legally if he was drunk and the engine was running, even if it was to keep him warm, he could have a problem.
If this was an isolated incident then the authorities should cut O’Neill some major slack. If not, then get him some help. Our vets deserve our help and consideration when they need it.

This was Colorado, middle of the night. Probably he left the engine idling so he wouldn’t freeze while he got a bit of sleep.

They were lucky he wasn’t out trying to jump his vehicle over trucks.
You must shut off the engine PLUS! take keys out of the ignition. Put them in yr pocket. I have read about guys sleeping it off. Engine off but keys left in the ignition. They got charged because the judicial system (police, judges, bailiffs} needs new fresh meat to pay their gov't salaries. Plus lawyers and bail bondsmen.
A lawyer will tell you to avoid a non-moving DUI, move to the passenger seat.
