EPA Fails to Acknowledge It Coerced Mine Owner to Grant Access

The Environmental Protection Agency isn’t responding to claims by Todd Hennis, owner of the Gold King mine in Colorado that the agency coerced him to grant access to his property. Once taking over, of course, EPA’s incompetent attempts to remove debris created a massive 3 million gallon toxic waste spill from the mine.

Hennis told the CBS Denver affiliate that unless he allowed the EPA to have access and authority to conduct operations on the site the agency had threatened him with daily fines of $35,000.

“When you’re a small guy and you’re having a $35,000-a-day fine accrue against you, you have to run up the white flag,” Hennis explained.

Breitbart News asked the EPA on Friday to confirm or deny Hennis’s claim, but has received no reply.

It is not clear if Hennis complied with the request based solely on the threat of fines, or if he complied after the agency actually levied at least one day of the $35,000 per day fine.

Using the threat of huge daily fines against individuals and small business owners who lack the financial resources to fight back against such intrusions is nothing new for the EPA.

I ran a public water supply for 30 years. We were having a problem with Iron in the water. During an EPA inspection, they told me, “Oh! You should start using AquaMag.” So I did, and being a very small company, 300 connections, the cost of installing equipment etc., was a burden. 2 years later, the same EPA team came out and demanded that I immediately turn off the equipment! I told them that they would have me turn the system back on after I complied with their demands, and they said “Yes. You’re correct, but we have rules.” I had to commission an engineering study, pay a fine,,,,and,,,pay a percentage of the cost to the EPA! They then told me I could turn the AquaMag phosphate system back on! Insanity!

Similar sort of story I have involves a shortline railroad’s locomotive shop. They had a contract with Safety-Kleen to service the shop’s parts washer, monthly.

They had a major overhaul on one of their locomotives underway and requested an extra service call to replace the parts washing fluid.

Safety-Kleen made the service call for the extra 20 gallons of solvent they took back to be filtered and reprocessed into new parts washer solvent... but they simultaneously reported the railroad to the DEP/EPA for exceeding their permitted monthly volume of hazardous waste.

Needless to say even though that was not my shop, the next time Safety Kleen showed up for their ROUTINE servicing at mine, I instructed the Safety-Kleen kid that our contract with them was hereby cancelled, in writing (handed him a copy of the certified letter), and that he is to IMMEDIATELY removed SAFETY-KLEEN’S toxic, carcinogenic, HAZARDOUS WASTE from the railroad’s property.

I then set up the old parts washer that was in storage and just used naptha and diesel fuel as the solvent. Filtered fluid was burned in the UNPERMITTED waste oilburner I installed for shop heat, the sludge was dumped in the coal pile and incinerated in the steam locomotive.

I will never do business with Safety-Kleen, EVER.

The EPA caused this spill INTENTIONALLY.

A letter to the editor by Dave Taylor, retired geologist, predicted it will happen a week earlier, and that it was easily avoidable. Instead, the EPA moves forward, destroys the river, and requests more cash. They want Colorado mining hurt, and they don't mind ruining a river to get the job done.

Freakin morons!!! EPA is the worst and most destructive Federal agency. If they all porn surfed all day America would be doing a lot better and same for the economy.

I would love to take a stroll through EPA offices to see how heavily affirmative action the place is. I will bet 85% of the employees are women and minorities. IDIOTAS!!!

You hit that nail on the head; “the SOLUTION to POLLUTION is DILUTION”.
I figured out what a scam Storm Water Control was all about when the company I worked for (a school district) asked me to be their Storm Water Manager.
My education was in waste water and potable water treatment and distribution.
My bosses knew what my degree was in so they decided that I was the ideal candidate for the DESIGNATED FELON job.
The classes cost me about 3500 dollars and 4 semesters of work to be a licensed Storm Water Inspector and Management Planner.
It’s all a grand scam, the mud and rain water on the outside of the contractors fence is the same as the mud and rain water on the inside of the contractors fence.
But GOD help the contractor if any of his mud or water winds up outside his fence.
