‘You’re Fired – Now Train Your Much Cheaper Foreign Replacement’

f you were laid off from your job, would you be willing to train your replacement if your company threatened to take away your severance pay if you didn’t do it? And how would you feel if your replacement came from India, and the only reason your company was replacing you was because the foreign worker was a lot less expensive? Sadly, this is happening all over America – especially in the information technology field. Huge corporations such as Disney and Southern California Edison are coldly firing existing tech workers and filling those jobs with much cheaper foreign replacements. They are doing this by blatantly abusing the H-1B temporary worker visa program. Workers that had been doing a solid job for decades are being replaced without any hesitation just because it will save those firms a little bit of money. There is very, very little loyalty left in corporate America today. Even if you have poured your heart and your soul into your company for years, that ultimately means very little. The moment that your usefulness is over, most firms will replace you in a heartbeat these days.

When I learned that Disney was doing this, I was absolutely outraged. Talk about a company that is going down the toilet. The following comes from the New York Times…

There is a story out now that Disney prevented fired American workers from working for any contractor who also worked for Disney. This could be because of Disney’s fear of theft of proprietary information. That wouldn’t justify it, of course. The whole H-1B system is wrong, except when the foreign worker truly has skills that can’t be found in our experts.

And now Obama has extended work permits to all spouses of H-1B workers. He did this AFTER the fuss started to be made about H-1B. He is never finished laughing in the face of conservatives.

Not just conservatives. His policies violate the law and even let terrorist have easier access. Also he has flooded some areas with immigrants from radical islamic culture and it negatively impacts services and culture. Anything to “fix” us in his image.

Of course the headhunter wouldn’t reveal who their client was, but I later learned that to “comply” with the H1-B laws, they will often come up with ridiculous certification requirements that they’ll publish to “ensure” that they can place a foreign worker, since no citizen would have those skills.

That sounds an awful lot like what I went through with one job interview back in the mid-1970s, which was then the heyday of "affirmative action", not for H1B foreign workers but US citizens of "minority" or "disadvantaged" class, which meant mainly women and Afro-Americans. One of the requirements was to take a test in basic logic skills, designing system flow, programming, flow charting, just basic IT stuff. There were like 10-12 of us taking the test, I was the only white dude. I blew through the test in half the time of anyone else, got the highest score. So they changed the test and re-tested everybody. Same result. So they changed it again and re-tested everybody. By now I could see what they were doing, changing the test to get the outcome they wanted (kinda like 'Rats and election recounts). But the same result happened again. Finally they threw in the towel and just told me that while I got the highest scores they were "selecting another applicant" for "other" reasons. I talked to a lawyer and he said I had a case for discrimination, but it would cost me and even if I got the job they'd make my life miserable for causing them the trouble. So I said to hell with it.

That's their culture - a reluctance to admit they don't know.

In the past I've worked with some, and they'd always look at you, smile, and repeatedly say "Yes? yes?" Half hour later, after screwing up Big Time, and there was no way out, they were at the door to my office rocking their heads side to side, saying "I am not understanding".

I loved my teams there. Very sweet people. However they had no incentive to work smarter not harder. When I went to visit and totally ripped up the processes and reduced head count, the BPO wasn’t very happy. Its challenging at best. I had vendors call me because the y didn’t speak “English”. Of course they did, just proper British English. Sad part is those folks saw very little in compensation.

In the future, employment tests will have questions such as: "Name a member of the Wu Tang Clan." "Name three artists affiliated with Death Row Records." "What NBA team does Carmelo Anthony play for?"

Sadly, this is happening all over America – especially in the information technology field. Huge corporations such as Disney and Southern California Edison are coldly firing existing tech workers and filling those jobs with much cheaper foreign replacements.

Sadly, so far, instead of this happening all over the country, these two companies are the only examples of this happening.

It would be nice if someone could provide more evidence, than just these two companies, for a problem that is supposed to be a national corporate epidemic!

I don't understand how an H1-B worker can be that much cheaper. A company had to pay $15k-$20k in costs up front just to get the H1-B. Then the worker can jump ship and take the H1-B immediately. I worked at a company that refused to hire H1-Bs because they got burned twice on that.

Now, L1 Visa workers can't leave their company unless they get an H1-B from another company. But they have to work for the company for a year outside the country before they are eligible.

Why was it in the headhunter’s interest to place a foreign worker? He gets paid less, if the person he places makes less money. But most headhunters would just want to place someone as soon as possible anyway.

Dude this happened to me in the 1990's while I was at "Large Mainframe Company", I had to train my foreign green card H-1b replacement. This problem is old, H-1b has been around for a long time.

The proof or the evidence is growing, albeit, very, very, very slowly.

I empathize with those that this has happened to, however, so far, the evidence does not support that this is some sort of national corporate epidemic of bad behavior.

This is one reason I went from being a developer to a BA. The latter is communication intensive, and all that that implies. :-)

Besides salary Green Carders don't quit. Green carders have no family. Green carders don't complain at 70 hour work weeks.

Usually the charade works like this. The company ALREADY has a green card type waiting in the wings. The head hunter puts in a good show/front that they tried to find someone qualified. The requirements posted are usually ridiculous. When the mandatory amount of time has elapsed then suddenly this green card resume appears on the recruiters radar.

It is a scam and a game to short change US IT workers.

In 20+ years in the IT Industry, with a resume that includes at least 10 different companies (some Fortune 50, Fortune 500, all the way to very small) (Lot's of contracting), I've never seen this type of behavior.

Whether or not someone puts out training on how to steal jobs in America is not proof that someone actually took them up and implemented their training in real life.

Show me the proof besides just SCE, Disney, and yourself.
