The “was under the influence of marijuana the night of the accident enough to impair judgment” finding probably would end any hope of a civil suit. But we are talking about lawyers here and there are some sleazy ones out there. I know of at least one.

I heard the same on FS1 directly from the AG’s mouth at the DEpressed Conference. In fact I got it on DVR.

Happy to see the end of this part of the saga at least.

Bound to have some lasting effects on Tony, I would think.

Not sure how the MJ thing will play on the civil side, but it sure won’t help their case.

Stewart Statement: Following a thorough investigation and presentation of all the relevant evidence and witnesses to an Ontario County (N.Y.) grand jury, the grand jury has determined there is no basis for the filing of any criminal charges involving the tragic accident of Kevin Ward Jr. on Aug. 9 at Canandaigua (N.Y.) Motorsports Park. The following is a statement from Tony Stewart regarding the grand jury's decision.
"This has been the toughest and most emotional experience of my life, and it will stay with me forever. I'm very grateful for all the support I've received and continue to receive. I respect everything the District Attorney and Sheriff's Office did to thoroughly investigate this tragic accident. While the process was long and emotionally difficult, it allowed for all the facts of the accident to be identified and known. UPDATE4: A grand jury has decided Tony Stewart will not face charges for his role in the on-track death of sprint car driver Kevin Ward Jr. Prosecutors in upstate New York made the announcement Wednesday, just hours after the grand jury finished hearing testimony in the case. Ontario County District Attorney Michael Tantillo also said Ward was under the influence of marijuana at the time of his death, according to toxicology reports. Tantillo looked at the evidence and could have brought charges or dropped the case himself, but said last week that the matter would be decided by the grand jury. Stewart could have been charged with second-degree manslaughter under New York law, experts said, if prosecutors believed he "recklessly caused the death of another person." Negligent homicide also was another possibility.(ESPN)

The grand jury has completed its investigation. During the course of the grand jury presentation, approximately two dozen witnesses testified. These included a number of race car drivers, racetrack employees and volunteers, two accident reconstruction experts, medical personnel, and a number of police officers. In addition, the grand jury reviewed a number of photographs and video recordings, as well as other documentary evidence. After listening to and questioning all of the witnesses, and reviewing all of the evidence, the grand jury has determined that there is no basis to charge Tony Stewart with any crimes; his case was "No-Billed" by the grand jury." I originally felt this should not have gone to a grand jury, but for Stewart, given today’s result and other information, he may be far better off. This really closes the case. Given Ward’s level of MJ influence, this may even relieve some of the feelings we all know Tony had to have. It’s still painful and I do feel for Ward’s loved ones.

I feel that overall this was the best way to do the investigation- involving as many people/entities/data/video/drivers/track workers, etc.

Taking the TIME and NOT rushing to a conclusion at any point by any Legal Entity.

Being as OPEN AS LEGALLY POSSIBLE was also a very good choice.

NY State GJ is made up of 23 Jurors. It takes 12 of the 23 to bring charges.

Dittos on the Prayers for ALL involved.

As sudden death does this will stay with all for a long time if not Life.

I'm Posting this in fairness to All Involved. I missed it yesterday.

Ward's family statement to ESPN on Wednesday, said: "Our son got out of his car during caution, while the race was suspended. All other vehicles were reducing speed and not accelerating except for Tony Stewart, who intentionally tried to intimidate Kevin by accelerating and sliding his car towards him, causing this tragedy. The focus should be on the actions of Tony Stewart and not Kevin. The matter is not at rest and we will pursue all remedies, in fairness to Kevin."(ESPN)(9-24-2014)

I understand the Ward Families pain and hatered that Tony was not hung from a rope in the Town Square. However they need to realize that Kevin Ward Jr. WALKED INTO THE RACING LINE AND GOT HIMSELF KILLED!!! MR. WARD SR- YOU NEED TO STAND BACK AND LOOK AT THINGS FROM ALL DIRECTIONS!

PORT LEYDEN -- Three hours after it was revealed Kevin Ward Jr. was high on marijuana when he got out of his vehicle and was killed by a dirt-car driven by Nascar driver Tony Stewart, the Ward family says the focus should be on Stewart's actions, not their son's.

After mulling over the evidence for two days, a grand jury ruled Stewart would not be indicted on charges related to Ward's death.

But the Ward family says the matter is not at rest.

In a statement, they said:

"Our son got out of his car during caution, while the race was suspended.

All other vehicles were reducing speed and not accelerating except for Tony Stewart, who intentionally tried to intimidate Kevin by accelerating and sliding his car towards him, causing this tragedy.

The focus should be on the actions of Tony Stewart and not Kevin. The matter is not at rest and we will pursue all remedies, in fairness to Kevin."

In a news conference Thursday afternoon, Ontario County District Attorney Michael Tantillo said his office combed through the evidence extensively, even re-creating the crash twice.

It was August 9 when Ward climbed out of his car after it spun out racing alongside Stewart in Canandaigua.

The 20-year-old star on the circuit walked down the track, waving his arms in what witnesses interpreted as an effort to confront Stewart.

An autopsy revealed Ward had enough marijuana in his system to "impair judgment," but some neighbors like Robin Kohl say they simply don't believe this.

"No I don't believe that, I do not believe that. Money talks. It's the way it is with anybody. If you have money you can get away with it. That's just the way it is. Look at what's going on right here," says Kohl.

In the tiny village of Port Leyden with no more than 700 people, this news is getting a big reaction.

Donna Post-Belmont is the grandmother of Kevin Ward Jr's girlfriend. "Tony Stewart went around the track after causing Kevin to crash, taking him out of the race and ran him over. It sounds like homicide to me," says Post-Belmont.

Brandon Baslow grew up with Ward Jr. "How don't you get reprimanded for something like that. It is beyond me. Especially on a caution. It pisses me off personally, it pisses me off really bad," says Baslow.

David Baslow lives in Port Leyden. "He should've been off the gas pedal and under that yellow caution like everybody else was. He was right into the (wall) winding it. It's wrong, it was wrong. It was wrong all the way around. Kevin didn't deserve to get run over," says Baslow.

Many neighbors say they will not accept this result -  they want the case to be re-opened.

Zachary Wimer lives on Port Leyden. "Get justice for Ward, re-open the case, re-investigate it. Do something, that's not right," says Wimer.

I see one person quoted as not believing that Kevin had taken marijuana.

Everyone else is trying to say it is Tony’s fault, not addressing the drug use.
