A 400-pound Staten Island dad of six, suffering for asthma, died Thursday after a cop put him in a chokehold and other officers appeared to slam his head against the sidewalk, according to a video of the incident published on The Daily News website.
I cant breathe! I cant breathe! Eric Garner, 43, is heard screaming after at least five NYPD officers took him down in front of a Tompkinsville beauty supply store when he resisted an arrest.
Within moments Garner stopped struggling and appeared to be unconscious as police called paramedics to the scene.
The Staten Island resident was sitting in front of Bay Beauty on Bay St. and Victory Blvd. just before 5 p.m. when two plainclothes cops began questioning him about selling untaxed cigarettes, the Daily News reported. he started yelling at the cops that he was innocent.
A guy, who shot the video below, tried to intervene, telling the cops his friend had just broken up a fight between three men and had not been selling cigarettes. But when backup uniformed officers arrived, the cops moved in to cuff Garner, the video shows.
Dont touch me, please, he said. When Garner refused orders to put his hands behind his back, one of the plainclothes cops got behind him and put him in a chokehold, the footage shows.
Three uniformed officers joined in on the arrest, knocking him to the ground. He screamed, I cant breathe, I cant breathe! Get off of me, get off of me! several times before he went silent.
In a statement on Friday, NYC Council Speaker Melissa Mark-Viverito called for a full, transparent and thorough investigation into the incident which led to the death of Eric Garner. New Yorkers expect and deserve to be safe and those protections must include those who are in the custody of NYPD.
Mayor Bill de Blasio said in a statement, On behalf of all New Yorkers, I extend my deepest condolences to the family of Mr. Garner, who died yesterday afternoon while being placed in police custody. We have a responsibility to keep every New Yorker safe, and that includes when individuals are in custody of the NYPD. That is a responsibility that Police Commissioner Bratton and I take very seriously. We are harnessing all resources available to the City to ensure a full and thorough investigation of the circumstances of this tragic incident. The NYPDs Internal Affairs Bureau is working closely with the Office of the Richmond County District Attorney, which is leading this investigation.
The mayor will have a press availability at City Hall this afternoon, before he takes off for vacation in Italy.
As soon as this man's eyes rolled to the back of his head, they wanted everyone with a camera out of there.
A tactic by agents of the government is now to stand directly in front of those attempting to obtain video or images of the scene and back them away and block their field of view.
That's precisely what the autopsy did not find.

The video I saw showed a group of LEOs putting a man to the ground and holding their knee on his neck while he gasps for breath. Oh, and all because he was SELLING single cigarettes to passing foot traffic.
Don't tell me they couldn't have issued him a simple citation and NO physical altercation was necessary. You must be one of dunces that slo-mo'd the Rodney King beating and then saw something other than a man being beaten.
Did you even SEE the video. It was removed within an hour or two of being posted. It told me everything I needed to see and it was NOT edited from what I saw.
Listen,....I have filled out several hundred death certificates. Everyone, ultimately dies of hypoxia, --caused by cardiovascular collapse, ---caused by (You fill in the blanks....myocardial infarction - caused by coronary artery occlusion - caused by....whatever cause..perhaps hyperlipidemia, perhaps cyanide poisoning, perhaps volume depletion,, perhaps septic shock, perhaps perhaps tension pneumothorax with shift of the great vessels,....you fill in the blanks.

What you did see: one cop put him in a submission hold (not a choke hold, because you can't shout and yell if you are in an actual choke hold).
Four cops putting body weight on him to keep him from taking a swing.
How would you arrest a 6'4" 350 lb man who didn't want to be arrested?

The plan was to take him down to the ground and control his physical movement and arrest him. The problem is THEIR actions resulted in the death of this man....not the deceased standing there on the street....not him talking to people walking buy......not him talking to the cops....It was a direct result of these men getting on top of him and one of them choking him. If he had such an illustrious arrest record, they had to have had at least a sketchy medical history,....you know CAD, asthma, etc. The cops acted and their action resulted in this mans death. Under our jurisprudential system if a person gets in a car, drives to the Dairy Queen for an ice cream cone and runs over a child and kills him, involuntary manslaughter will be charged. I suppose you saying he had CAD justified him being killed. Many people use the term loosely to refer to Mi or myocardial infarction. Well, lets take a look at that. What causes an MI?.....occlusion of the coronary arteries with resultant hypoxia of the cardiac muscle served by that particular vessel, coronary artery spasm, stress, physical exertion, drugs, and many other things.. You seem fixated on his weight....not the stress which he was deliberately put through, which, in my opinion, seemed excessive. Now you also absolutely deny he did not die of asphyxiation. Perhaps airway occlusion would be a better term to use. Airway occlusion does not mean 100% occlusion. Many people die as a result of airway occlusion when their bronchi are occluded 50%, 60%, OR less. One may also not be able to 'move' air if there is so much pressure on the abdomen and chest that the chest will not move through an excursion and thus, move air in and out oflthe lungs. People with obstructive lung disease will have problems ( emphysema, chronic bronchospasm, asthma) or restrictive airway disease. Any occlusion will increase resistance of airflow, and if he is compromised there may not be enough airway to sustain life WITHOUT crushing his trachea. Yes, I would love to read the autopsy report.

I have sat on 3 juries. If I looked at the video, the silly notion that he died of natural causes would be unsellable.

I have a friend who got stabbed in a bar. After 3 punches and one kick to the head the stabber died and my friend had to do 17 years. If a cop even sees a knife he unloads a clip into you no questions asked. It’s not right!

But a source close to the Medical Examiner's investigation said coroners are also investigating whether the chokehold still contributed to Garner's death by aggravating his pre-existing conditions of obesity, asthma, and possible heart disease..............."If an obese person with co-existing medical problems can't get good oxygenation to begin with, then a chokehold could put him over the edge," and lead to a homicide finding, the source said"
You see, most of us over 50 have some extant medical condition. We get along, but we are not physiologically perfect. Take for example the 71 year old fellow who walks through the mall for exercise and some 'knock-out' thug runs by him and hits him on the head and he goes down with a subdural hematoma and dies. Now the thug was not the cause of this fellow being 71 years of age, but his act was the proximate cause of the man's death. Your argument seems to be,....he was old with concurrent disease and tenuous strength in the wall of the vessels of the brain or dura, and therefore it was just one of those things. Now, assuredly the intent to kill may come into question in both of these scenarios. The cops were arresting him and the striker just wanted a good laugh at the expense of the 71 year old. Both men are dead. But the Proximate Cause of death seems clear in both cases. Neither man should be dead. Who is responsible? It seems clear a jury should make that determination. No one is above the law.
