He has no deed to that land, which is the only way one can acquire title to surface rights.
Bundy himself admits that he owes rent, he just says that he wants to pay it to the state of Nevada - which does not own the land - as opposed to the federal government, which actually does own the land.
The land was possessed prior to the treaty, thus under the treaty the US has no claim to the possessed usage.
You can’t fool me with your mouthy ignorance, I am very familiar with land rights under this treaty, as all of California’s arable land falls under its jurisdiction.
