It was suggested that I should post this in the public forum instead of keeping it in Freepmail.
The monster who raped me is coming before the board of parole again. Every 3 years.
I ask that anyone who may have a reason to want him to stay behind bars, please consider writing the board (by email) expressing their thoughts about his release. He is a 5-time felon. The attack happened in Texas, the day before Thanksgiving, 1990. He broke 6 locks on my front door.
When he was raping me, he made it clear to me that I would not be his last victim. He told me that if I helped prosecute him, he would kill me when he was released. He also assured me that he would never again leave a witness. He told me he would kill next time because he wouldn't allow himself to be put back in prison.
I am blessed that I wasn't killed. I thank God every day for that blessing.
He is a five-time felon. Each one of his crimes was progressively worse than the one before. His attack on me was brutal. During the attack, he took every opportunity to make me feel inferior. He justified his attack by claiming I deserved it because of the way I dressed.
It's been 22 years since he attacked me, yet it feels like it was yesterday. I will always feel fear; I will always worry about my own children being attacked. I will always worry that he is around the corner waiting to kill me. I will always feel the need to watch over my shoulder. Please help me convince the board to not release him. Please help me convince them to make him serve his life sentence. Please help me keep them from releasing another sexual predator on the innocent.
Before they caught him, he ran to Florida to escape. I believe no state is safe from this monster.

I really don’t mind the gun talk. I’m an enthusiast myself, some of these people are friends I have had the pleasure to meet, and it was this exact thing...in 2005...that prompted me to get my license and a gun. Not to mention, it kept the thread bumped so more people could see it. But I truly do appreciate your concern about keeping it on topic. Bless you for being willing to write the board on my behalf.

If you manage to get a TV interview, it would be prudent to ask them to conceal your face. They usually do when covering similar cases.
I am so depressed.
I got a call today in response to one of my records requests. It was regarding his revocation hearings records. The lady told me I could get them, but it would be expensive. She said there were several records and each one would be over 80 pages...and they charge by the page. She couldn’t tell me how much until she got them all pulled, going back to 1981. Looks like I won’t be able to get that one. :(
At this point, the file is back with the parole board and I am waiting on the records I requested. which are:
All court documents in the file
Registration affidavits & Representative Summary Forms
Copy of Blue Warrants
Copy of White Warrants
Minute sheet
Arrest Report
Any order granting or removing him from any annual report status
Public information display screen.

I’m sorry to hear they’re jerking you around. If there’s a price per page, they should at least be able to tell you what that is & then you could say you’d be willing/unwilling to pay for 80+ pages.

There is a price per page, but she doesn’t know exactly how many pages until she gets all the files pulled. It will be about 320 pages, give or take ?
I didn’t think to ask how much per page...since I know I couldn’t afford to pay for it anyway. I told her to let me know how much when she gets them all pulled.
Get everything you can afford together.
If you have to borrow a few bucks from your friends and family, do it.

I think they charge about 25 cents a page here but no idea what it is where you are. As someone who is a victim in this, I would think the cost would be waived. You may be able to ask that it be.

I mentioned that I was the survivor in this case and asked if that made any difference. I was told that it doesn’t. Family of the criminal, and family of the victim, as well as the victim and any other person who asks, all pay the same price. Wish I had thought to ask how much per page. :(

Wow...I got a packet of paperwork from the open records request I requested...Sure wish I could share it with you all. This guy is a career criminal!
Well, I got notice today that some of the papers I want to get are going to cost...alot.
I asked if I could get the fees waived since I was the “survivor” in the case and they said “no, victims and family of both sides pay the same amount”. Bummer...Wish I was working :(
Sitting here as an emotional wreck.
Just got off the phone with Mr. Lafavre from the parole board. He was calling to get my comments about the subject of parole. He thought it would give me comfort to hear that he spoke with the inmate today, and that the inmate is (supposedly) remorseful, and wants to be released to Lubbock Texas to marry his fiance. (how does a 21 year inmate get a fiance?) That he won’t be back in prison if he is allowed release. (remember his promise to kill next time so there is no victim to testify?). That he’s 53 years old and is a Level 3 trustee (still not trusted enough to be outside the facility).
I asked him if he had grandchildren. When he said yes, I asked him if he could live with himself if he voted to release this monster and had his grandchild hurt by him. Or his daughter, sister, mother, niece.
I reminded him the sentences from the prior convictions: Received 5 years for Theft, burglary of a habitation: Aggravated Assault, 1978
Received 2 years for theft, 81
Received 12 years for Theft, burglary of a habitation: Aggravated Assault, 1984
Another charge, unsure what and when, but received a 15 year sentence
The attack against me 85 years, 1990
I told him the file says this convict was Continually absconding...I said “doesn’t that mean he runs away? He leaves the state or goes where he is not permitted to go, and doesn’t let his parole officer know...and wasn’t he absconded when he attacked me”?
I had this statement prepared...but I also said much more:
Having requested every document I can get, I still cant figure out how long he has been out on parole before re-offending and going back. How long was he on parole before he attacked me? It looks to me like he was released on 10/8/90, and attacked me on 11/21/90. Could you live with yourselves if you released him and he attacked again? What if he attacked your mother, daughter, niece, sister? Your grandchild? He promised to kill next time so he wouldnt be put back in prison. Can you be sure, in your own mind, that he wouldnt do exactly that? He has proven many times how violent and dangerous he can be when he punched another inmate in the face while that inmate was on the phone. It was a totally unprovoked action. Im sure that isnt the only violent action he has had while in prison.
Notes on the warrants says it perfectly Failed to fulfill the terms and conditions of release and is therefore NOT worthy of the trust and confidence therein placed
The jury recognized the danger he presents and chose to give him 85 years. They got to see his face while he testified. They got to see my face while I testified. He has only served less than 22 years of that sentence. The jury would be ashamed to find out that their recommendation wasnt understood. The instruction given to them was 5 to 99 years, or life. They believed his actions merited 85 years. His attack on me was brutal. He forced his member into my mouth, he forced me to submit to being penetrated. He told me he had AIDS. He told me he would kill me if I didnt submit. He told me he would kill me if I told. He told me he would kill me if I testified.
Mr. Lafavre told me my comments didn’t fall on deaf ears...that he will take everything I said into consideration, and that he hopes I will eventually have peace from the torment I deal with over this attack. He also said it’s time to decide if they are going to house him forever or if they are going to release him on parole and watch over him. He told me the 3 years time frame for hearings was mandatory and that “serve all” was not an option that would apply here, as he has “too much time left to serve his maximum sentence”, which wouldn’t end until 2075
If 3 board members say “no”, he stays in...if 5 say “yes”, he is released. Once they have 3 “no” votes, the voting stops. Mr. Lafavre will cast his vote today, then pass the file along. It can take 30 to 45 days to get a decision. Please...pray!!
