There is growing talk that Vice President Biden will be booted off the ticket by President Obama. But dumping Biden begs an urgent question: Where to dump him?
Just dropping him in Delaware to roost and reminisce is an indignity that would redound politically against the president, who would seem harsh and ungrateful.
Obama could try to convince one of the two septuagenarian liberals on the Court to remove themselves after the spring term ends next month. Or, he could assure Biden of an eventual appointment and announce that Biden will not run for reelection because Obama would have to appoint a vice president after Biden resigns to go on the Court, and vice presidents should be elected.

Ruth Buzzie Ginsberg announces her retirement. Hold a quickie proforma Senate hearing the next week and send it to the floor of the Senate the next day. Our Constitution and traditions mean nothing to these people. There is no such thing as an impossible outrage.

FOR THE MINORITY: Justice Scalia delivered the opinion of the dissent: This case does not show that a private individual may assert qualified immunity only when working in close coordination with government employees. For example, Richardson's suggestion that immunity is also appropriate for individuals "serving as an adjunct to government in an essential governmental activity," 521 U. S., at 413, would seem to encompass modern-day special prosecutors and comparable individuals hired for their independence. There may yet be other circumstances in which immunity is warranted for private actors. The point is simply that such cases should be decided as they arise, as is our longstanding practice in the field of immunity law.

Which is why we should never have chosen a liberal for the Republican candidate. If this were ever to happen, we would lose big. People seem to love the Clintons and people seem to not like the big fat liberal Romney...can’t say I blame them for that. It is not too late to dump Romney.
It seems to me, that if Democrats don’t want this to bite them in the future, they will give Biden an ambassadorship, not a Supreme Court appointment.
There isn’t any pending rulings that I’m aware of, so it would be a waste of the next 6 months.
Secondly, if Romney gets elected and does a decent job, there are three justices that might be retiring within the next 8 years that Romney could appoint, which would put a Republican lock on it for the next thirty years.
After seeing what Romney appointed in Mass, I don’t have a lot of faith in his appointments.

Id say that the Indianapolis Colts have a better chance of winning the Super Bowl, Krauthammer said. And I have only one reason for saying that, and that is Obamas I say this not as a clinician narcissism.
Obama, I think, can never bring himself to do something very large, like this, which would show that he needs the Clintons, particularly Hillary, to win.
I just think for Obama to show himself as being weak and needing this to win is more than he can ever muster, Krauthammer added. So I think the odds are low. I could be wrong rarely, but its happened.
