If Obama's father was a Kenyan then how could Hussein be eligible to be POTUS?

Because his mother's citizenship, plus his birth within the United States conferred upon him citizenship at birth, therefore making him a natural-born citizen as opposed to one who was naturalized after birth.

but his birth in these United States is the real question.

A U.S. citizen at birth is a natural born citizen, as opposed to a naturalized citizen.

In U.S. vs Wong Kim Ark it was found that the child of two Chinese nationals born in territory under the jurisdiction of the USA was natural born.

So far from needing two U.S. citizen parents to be natural born, one needn't have either parent be a U.S. citizen; so long as by the natural act of being born one has U.S. citizenship conveyed upon them.

But the correct answer isn't always what people want to hear.

Nope.  Traditional Citizenship is defined by your fathers Nationality in all countries.

Further his natural born eligibility is eroded in the definition of allegiance, citizenship and laws that govern you as a citizen of the country from whence you came.

You will find a further definition in the 14th amendment:


All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.

Barry's Father was a citizen of Kenya and subject to jurisdiction of said country.  In other words he is entitled to or restricted to any conveyance of laws by the country of Kenya.

Barry acknowledges this and apparently no one cares.  Barry tells you proudly that he was a citizen of Kenya due to his father's citizenship.  It is there in plain view, unabashedly.

Was Barry a citizen of the United States at the time of his birth?  The answer is probably no and you will find others who will add to this post, shortly.

Even if he was born here, which is very much in doubt, he cannot be a "Natural Born Citizen" as his father was a Kenyan, making him a citizen of Kenya.  If one wants to extend to him citizenship because his mother was born here and was citizen at the time of his birth, again the argument that he is "Natural Born" falls apart and he admits as much.  At best he would have a divided citizenship and thus his ability to be President by a clouded birth of citizenship which the Constitution, the Supreme Law of the Land, makes a clear distinction as to who qualifies.

Bottom line is Barry was a citizen of another country at birth and his citizenship at birth is clearly not natural born.

Both Parents are required to citizens of the United States and subject to the jurisdiction thereof.  You will find reasons why they could be disqualified as being under the jurisdiction of the United States to bolster your argument but that might be for another time.

Established dicta is considered as to one of themore reliable methods of determining original intent. Examine John Jay's 1987 letter to G. Washington wherin he urged him to adopt Vattel's Law of Nation's definition for "natural born citizen" for inclusiom in Article 2, Sec 1, clause 5 of the USC. John Jay wrote: "Permit me to hint, whether it would be wise and reasonable to provide a strong check to the admission of Foreigners into the administration of our national Government; and to declare expressly that the Commander in Chief of the American army shall not be given to nor devolve on, any but a natural born Citizen." A natural born citizen is born in the nation where the parents are BOTH citizens.
