I wonder about him, we have not heard too much about his alibi.
I heard early on that Finnerty's attorney NEVER talks to the press about his cases or clients.
And I have heard that some of the defense attorneys are upset with some of what is being released.

You're right, he could have been the photographer. I also wonder where the 6'6" McFayden was--we haven't heard about him in a while--He also has a million dollar home. Could he be #3?
I can see the difference in styles from the coverage.
IMHO, trying a case in the media is not usually a good idea, but since this DA has been doing it like crazy, I guess Seligman's attorney feels it appropriate.
With the racial tensions afoot, it might be useful, but I don't think it can counteract the race-baiters who have conducted rallies and taken a position on it.

I'll bet no. 3 does not get named until the accuser's circle of advisors has figured out who exactly appears in the photos of the party. The defense lawyers need to be especially on guard for leaks out of their offices, as some of the race hustlers might pay top dollar for a look at the photos to make sure the no. 3 that is chosen is in there.
Also, the accuser's people may be trying to identify who made the "she's just a stripper" comment, and ID him. Perhaps they will approach the cabbie and threaten him or bribe him to pick that guy out of the lacrosse team picture. Then we will find that that guy is the lucky no.3 defendant.
I wonder if Kim was the one who threatened to call the police--since that's what she did. And maybe that threat was the reason for the rapid disbursement of the remaining partygoers.

I assume the identification has already been made. The person just hasn't been charged due to lack of evidence (of course that hasn't stopped Nifong previously from making arrests). I'm not so cynical as to believe Nifong would allow her to ID someone NOW.

The leak was that she was 90% on the third person.
He allowed the other IDs to be made 4 weeks after the event, and after the identities and photographs of the lacrosse team had been highly publicized. Frankly, it's not any less prejudicial to let her make an ID now than it was 4 weeks after the event.
I wonder whether the accuser's circle of friends had access to the party photos somehow before she made her IDs. The picture of Reade is very clear and distinctive, and he has a face that is not easily confused for someone else. Perhaps the accuser's side paid off a paralegal or secretary in a defense lawyer's office, got certain that he was at the party from the photos, was from a wealthy family, he had scratch marks on his body, and decided to go with him.
The 2 IDs made to date were, according to news reports, made from a photo lineup consisting only of Duke lacrosse players.
So I think you are giving the police investigators and the DA too much credit, and underestimating the animus driving the race baiters surrounding the accuser. The stakes are high for them, they are playing for keeps, and I think it would be a mistake to put anything past them in this case.
