On January 6th, 2021, Ashli Elizabeth Babbitt was executed by a Capitol Police Officer who seemed to hold no restraint. 50 days later, the Capitol Police Officer responsible has been identified in photos before and during the shooting. The Police Lieutenant’s name is being withheld from Ashli Babbit’s attorneys.
This is the Officer responsible for using excessive force and executing Ashli Babbitt. Before killing Ashli, the Officer is seen aiming his firearm at fellow colleagues. You can see the Officer disregards nearly every basic firearm safety rule in the book. His finger is wrapped around the trigger, while his firearm is aimed in the direction of his colleagues.

Sorry, I know that is in pop culture lately. But it is not factual to say a cop can just dump someone with no weapon.
There has to be ability, opportunity, and jeopardy. THOSE circumstances met can place an officer into fear of his or someone else’s life. But saying he was in fear of his life without all three of those others being satisfied is illegal and that is HEAVILY established in Federal law. It’s a standard, not a mere opinion, despite what BLM says.
She had no weapon of any kind, (no ability to inflict great bodily harm on anyone) She was squeezing through a window (no opportunity, there was no act she could perform from where she was that could inflict a deadly threat on anybody) and last, she placed nobody in jeopardy (who was in immediate risk of her attacking them?) This is not satisfied either except possibly by him.
All of those met, then congratulations, you are now in the zone of options which must be precluded before advancing to the next higher level and ending in deadly force. He didn’t have pepper spray? The didn’t have a taser? He didn’t have an expanding baton? He couldn’t have simply gone hands on and placed her under arrest as she climbed down?
If he could and should have done one of those, and simply decided to shoot her, as he clearly did, it was murder.
By the way, all of that has to happen in a cops mind in a second or less. I recommend you stay out of law enforcement if you think you can shoot with immunity by saying “I was in fear” and that’s it.
There is one hell of a lot more of that iceberg than that tiny “I was in fear” tip. There has to be a huge legal standard met before that last phrase comes into play. And it wasn’t.
Dozens of cops across the nation have been sent to prison for less.

Oh and other little things. He had an opportunity to give a verbal warning from his superior position and didn’t. That is also an issue legally. That is the lowest level of the use of force continuum. A verbal challenge telling her to stop. Sometimes you can’t, but he had a clear chance to do that to try to gain control.
That has been a thing since the 1930s. It was an issue when Bonnie and Clyde were ambushed and shot to pieces. Even back then shooting without warning from ambush was very thin ice, even if you are out hunting Bonnie and Clyde.
The team said they yelled a challenge and then started firing. I personally wonder if they did, but they were smart enough to say they did.
But the guy has a very good chance of getting off. He is black, and a Brazilian immigrant, his police chief is black, the jurisdiction is in DC, he was assigned to Schumer, and the communists are in power. So essentially he will get off or not even be charged. But rest assured, that was a highly illegal shoot under every law enforcement standard since the early 1980s.
No funeral, no autopsy results, no death certificate...

Ashli’s family would like to give her the memorial she deserves, to honor her memory, and say our last goodbyes. As Ashli's sister-in-law and best friend of 22 years, I am currently asking for donations to help cover the cost of Ashli’s services. Due to the circumstances of her passing, the expenses of a memorial have become insurmountable for her family. It is possible that Ashli's husband has just refused to cooperate with the press.
Does Ashli have a husband or just an ex-husband?
He is not even in jeopardy for his life? Why did he murder the woman? There were police all around her. There must be charges, then he can clear himself if he is innocent. There cannot, just be a decision not to bring charges. That is not how the system is supposed to work.
Why is it we still don’t know the name of the person who shot Ashli, even though his identity is known. Isn’t that unprecedented?
No they were there as Senator Rand Paul’s security detail.
Senators have off-Capitol security protection by the Capitol Police. David Bailey and Crystal Griner were Rand Paul’s security. Paul gave a detailed description of the attack by this nobody Bernie-Bot out of work home inspector from Missouri(?) who opened up on everyone there, Scalise seriously. And we never heard what the end result was for a lobbyist for Tyson Foods who was also severely wounded— he may have been rendered immobile (paraplegic) from his wounds. Never heard.
They rotate the Senator’s coverage so these two probably are not on his detail at this point. Bailey is seen in photos put out early on in the Babbitt shooting— with a bracelet, not as large beads but similarly white and black color beads. They need to ID this particular Capitol Police member— as he is said to be Brazilian. David Bailey is not Brazilian.
