Liberal Supreme Court Justice In Waiting Who Never Was Laurence Tribe gave away the ultimate Democrat election game plan to Joy Reid on MSNBC on July 31. As he explains, via massive use of mail-in ballots which, as we have already seen, cause chaos, confusion, and delay, the electoral college could be unable to choose a clear winner of the election. If no winner is determined by this January 20 then, according to Tribe, Nancy Pelosi would become president...if the Democrats retain control of the House.

If voting is inconclusive or does not occur at all, most State Legislatures will appoint their Electors and if >269 Electors cast their ballots for a candidate, that person will become President at noon on January 20, 2021.

I agree. But the problem is most conservatives always let the protesting, rioting and squeaky wheel stuff up to unemployed young anarchist leftists. Conservative retirees and other conservatives need to be out there too protesting as they were in Wisconsin. We generally have a state of mind that abhors making waves and doing that kind of stuff.

The Electoral College meets in December. If no candidate for President gets 270 or more electoral votes, then the following happens:
1. Under Article II, Section 1 of the Constitution, the House of Representatives selects the President.
2. Under the 12th Amendment, the President MUST be a candidate who has received at least one electoral vote, and is one of the top three candidates who received electoral votes.
3. Here's the kicker, folks ... The House election process is not a straight vote for the President. The vote is taken by state, and each of the 50 House delegations has one vote. Even though the Democrats control the House of Representatives right now, I believe there are 26 states with a Republican majority in their House delegations -- along with one or two states with evenly split Republican-Democrat House delegations.
So Nancy Pelosi can't be become President under any circumstances in this scenario ... unless she runs as a candidate and somehow manages to win at least one state in the November general election.

This scenario would work this way...the EC fails (for various reasons) to reach 270.
Pelosi’s term as House Speaker ends on 4 January. A new House Speaker would then be elected by the incoming new members. Based on my hunch....a majority of Republicans would be in this group. The Republicans would meet that week and select their Speaker.
Added to this tension, probably 10 to 20 House elections in the various states will not be settled and delayed for a minimum of one to three months...meaning some may not get to DC until Feb.
The back-up method here is that the House would vote....state-by-state for the Presidency. If you have 9 Representatives, with five GOP....then that state would be a Trump state. If you had four Representatives and it was split 2 and 2....would be a zero sum state.
First count with 26 votes....that ends the President’s race.
For VP, the Senate votes....one man, one vote.
The only way that this gets more messed up is that forty-odd races are challenged and incoming Republicans are not appointed by their state to their position.
Pelosi could watch all of this occurring up until 3 Jan, but have no real hand in changing the outcome.
