Committees are now drafting bills to be presented in the March session of the Florida legislature. If enough citizen input is received demanding regulation of single family residences in Floridas gated communities and regulation of drug-re-hab centers now being located in private neighborhoods (which may or may not be gated), relief just may be coming for oppressed homeowners, their families, their children!
About ten years ago, the Flower Pots bill was successfully passed which regulated only residents of condo communities. However, the State of Florida was reluctant to do anything about giving protection to those of us who own and maintain our own homes in gated communities; protection, that is, from the same Condo Commando mentality that made life miserable for condo dwellers. Hopefully, Florida lawmakers will draft and pass legislation that can exemplify for the entire country just what is needed to protect long suffering homeowners from heavy handed tactics of Home Owner Association (HOA) boards of trustees, the legal firms they hire and the management services they engage to control residents, many of whom are elderly, sick, or too beaten down to fight back.
We all become aware of the tensions bubbling just beneath the surface of these Potemkin villages when some sick veteran is put through the HOA meat grinder when he tries to fly the American flag in front of a home he fought and sacrificed to make safe. But here are important issues Floridas lawmakers need to address first: 1. TERM LIMITS now are vital to stop the ingrained and perhaps, self-serving mindset of HOA board members who are returned to office by select cliques which they accommodate in a quid-pro-quo of political nastiness that shuts out other homeowners. That is what I think. Pro-HOA people use the phrase “voluntary contract”, which is only true if I can buy that same house without the HOA
That was really nice of them.
We lived in an HOA that fell apart and you could tell by the neighborhood and what was going on. Big campers parked in front of the houses, boats in the driveways, a guy parked his semi truck in front of his neighbor’s house every night. Dogs started running loose and terrorizing the neighborhood.
We put our house up for sale and got out. Last I heard no one was in charge and the guy that held the checkbook was using funds for his own home improvements:(
If you have a HOA that can’t get people to run for office and the people won’t participate and don’t care it can fall apart. This time we chose one that also had a property management firm running things as well as a BOD. It works better.
We love it here and it is the best neighborhood we’ve ever lived in.
People should be able to live the way they want to. If they don’t want so much control there are more rural options where there aren’t as many rules. Many people want a place where they mow the lawn, take care of the landscaping, painting and snow removal so someplace with a strong HOA is a good option.
I’m anti-HOA (don’t like them, wouldn’t live in one) but contracts are still voluntary.
People are not obligated to sell you something exactly the way you want it just because you want it.
I agree but in my state you can't see the HOA contract before the arriving at the closing. Who the hell would agree to that?

Some of those complaints were kind of silly. Again, sounds busybodyish. I don’t like the way you live, therefore I will force you to live the way I do... lets get into an HOA.
Grrr.
Not only that, but he is an electrician and is putting in new bathroom exhaust fans and wiring and running power to the new 10X16 shed, all for no charge (refuses even reimbursement for the materials). Working on them right now. All I have to pay for is the permits and none of this was even on the sales agreement.
Imagine the popularity of such contracts taking vehicle manufacturing by storm and every new vehicle buyer required by contract to leave an anti-Republican campaign paint job intact.
What if every new pair of pants came with a large hole in the rear end and a contract forbidding any buyer to cover it up? The Lawyer Party folks would love that for sure. And from the changes they’ve brought so far, it might be in the near future.
Here in florida its almost impossible to find a newer home (newer than 1960) that isnt in a hoa.

Most of the desirable properties are in HOAs. There’s probably a reason for that.
No, that has nothing to do with having an HOA.
It was a Contract between the Landowner and his Tenants. I would say Lease, but a Lease has a time restriction
I would assume that there an “out” in case the Property was Transferred or Sold. I’m sure there is more to the story. My Land, my Rules.
I’m not big a fan of Rent Control, so I can see the Buyer doing whatever they needed to do to get a profitable return on their Investment.
If you don’t want a Landlord, buy your own Land and House.
Living in the country was our dream. We had a mini farm. The people who lived across the road from us had pit bulls that ran loose. They also put in a dirt bike track around their house. Our houses were very close together but across the road from each other. Their kids ran those dirt bikes all day long. It was very noisy and we could not use our screen porch as the dirt would come right in through the screens. It was a miserable existence and we had to have a shotgun with us at all times because of the dogs. One of them bit my husband when he went out to get the mail.
There were no leash laws in the country and farm folk do not want to keep their dogs tied up. We would have bought another property out in the country but my husbands health turned bad and he couldn’t handle it.
When you have bad neighbors it doesn’t matter where you live. Your life can be miserable HOA or not. This is the first place I’ve lived where someone hasn’t left their dogs to bark all day long. You can’t tie your dogs out all day here. I finally have peace and quiet!!!!!

Every state should have laws that allow police to take dangerous animals. Dangerous animals can be fenced out. When dangerous animals attack, they can be shot. As for homeowners’ associations, people have been made homeless by outbreaks of camera spying, dishonest implications in gossip and lawsuits in such developments. That happened in a rural area on the CO Rockies over 10 years ago. Those who were able to pay the most in legal fees prevailed at the time.
