As we head into a potential government shutdown over the funding of Obamacare, the iconoclastic junior senator from Texas love him or hate him continues to stride across the national stage. With his presidential aspirations as big as everything in his home state, by now many know what has never been a secret: Ted Cruz was born in Canada.
But does that mean that Cruzs presidential ambitions are gummed up with maple syrup or stuck in snowdrifts altogether different from those plaguing the Iowa caucuses? Are the birthers now hoist on their own petards, having been unable to find any proof that President Obama was born outside the United States but forcing their comrade-in-boots to disqualify himself by releasing his Alberta birth certificate?
No, actually, and its not even that complicated; you just have to look up the right law. It boils down to whether Cruz is a natural born citizen of the United States, the only class of people constitutionally eligible for the presidency. (The Founding Fathers didnt want their newly independent nation to be taken over by foreigners on the sly.)
Whats a natural born citizen? The Constitution doesnt say, but the Framers understanding, combined with statutes enacted by the First Congress, indicate that the phrase means both birth abroad to American parents in a manner regulated by federal law and birth within the nations territory regardless of parental citizenship. The Supreme Court has confirmed that definition on multiple occasions in various contexts.

So the one remaining question is whether Ted Cruz was a citizen at birth. Thats an easy one. The Nationality Act of 1940 outlines which children become nationals and citizens of the United States at birth.

Problem is Ted didn't have American parents, he had an American parent and a Cuban parent. IOW, less eligible than Obama.

Cruz had American citizenship at birth. He was never naturalized. If he was not a natural born citizen, he would have had to have been naturalized years ago to be eligible to serve in the Senate. This didn't happen because his citizenship was intact from birth. Ted Cruz ia a natural born American.
Yes, just like Ted Cruz. But Cruz in known to have been born in Canada. And after all these years of discussion concerning Obama's birthplace, the only reasonably solid evidence is that he was born in Hawaii.

IMHO if Cruz takes the bait that he’s a NBC, and being a Constitutional scholar or something, he ought to know better, then the Dems/leftist will, at the very last minute, pull out info proving that one must be born on US soil to be a NBC - jus solis, IIRC. Of course the researchers here know that to be a verity.
I am 100% sure of this. They will pull it out. And claim that Steaming is a NBC since his faux birth cert says “HI”. And now so many are running with this - Levin, for example, and a lot on FR will now focus their ire on anyone saying “Hey, he ain’t a NBC - foreign birth, foreign national father - two strikes!” We’re trolls, we’re dupes, we’re leftist traitors.
Anyone who thinks he’s a NBC is duped. And pretty soon there’ll be a long thread zotting anyone who says he isn’t, mark my words.
And then at the very last minute, after he’s gotten the nomination, a judge somewhere will make the decision that jus solis determines NBC status.

False. He’s a natural born citizen of Canada, by virtue of having been born in Alberta.
Bonus, they take him out of the Senate. That’s the plan. Just like the plan was to have Newt folding to Romney folding to Obama. Newt suckered in lots of folks in the primaries. But, he was essential in keeping conservatives just divided enough.
Except that does not pass the intent of the Founding Fathers.
What if Cruz becomes POTUS and a dust up occurs between the US and Canada, trade deals, business deals or what ever. Could Cruz be viewed as having a bias, perhaps a soft spot for his birth place?
Maybe he has a loyalty maybe he doesn’t, but it could easily be argued there is a conflict of interest there, something we should strive to avoid as the Founder did.
A person born to two citizen parents in this Country is no doubt a NBC, any other variance leave a doubt of loyalty and possible conflict of interest.

No he is not a natural born Citizen. He is a dual Citizen with born allegiances to two sovereignties.
Here is what the principal framer of the 14th Amendment Rep John Bingham stated when defining a natural born Citizen:
Every human being born within the jurisdiction of the United States of parents not owing allegiance to any foreign sovereignty is, in the language of your Constitution itself, a natural born citizen. (Cong. Globe, 39th, 1st Sess., 1291 (1866))
Ted Cruz born within the allegiance of a foreign sovereignty called Canada to a foreign national father who owed allegiance to foreign sovereignty called Cuba is again, not a natural born Citizen. Ted Cruz is just a statutory Citizen only eligible for the Senate or House of Representatives.

I’d vote for Cruz in a heartbeat if only to shove the Obama precedent back on the libs but I’m afraid that there are probably enough diehard “birthers” to make his path to victory problematic. What I’d love to see Ted Cruz do is use his possible candidacy as a teachable moment - releasing his college funding records for example and explaining that as a dual citizen he needed to show that he never received as aid as a foreign student or lived in the foreign student dorm.
CAT also supports Open Borders, Illegal Alien Amnesty, and economically destructive Free Trade policies. How people think the are anything conservative when they are quite liberal on most issues
