Rep. Randy Neugebauer (R-TX) was on a Texas radio station yesterday where here explained his support a Republican floated bill which would mandate that all presidential candidates file birth certificates with the Federal Election Commission. When asked about Obama about Obama’s citizenship he said, “I don’t know.” Perhaps he needs to visit FactCheck.org.

Neugebauer was asked about the birth certificate bill. He said, "You know that is a Constitutional requirement, and when office holders go whether it is a city council, or a state rep or a United States congressman, there are certain requirements that they must meet, and you know there was some question in the last election, about both candidates, so why not just have that candidate furnish documentation that says that this particular individual is a natural born citizen and then all of these questions aren’t lurking out there. It doesn’t apply to the last election. Some people think it is a bill to throw out Barack Obama, it’s not. It’s saying in the next presidential election let’s make sure that presidential candidates meet the Constitutional requirement.”

The fact is that Obama’s birth certificate is not hidden. It is in his Chicago office. The reason why Rep. Neugebauer has never seen any evidence is because he doesn’t want to see the truth. The birther bill is going nowhere, because even if the bill was passed, conspiracy theorists would find some other way to doubt Obama’s citizenship. FactCheck also has high resolution photos of the Obama birth certificate. The birther bill is pointless and unnecessary. It is nothing more than a way to keep a conspiracy theory alive.

There's a slight problem with your suppositions here and that problem is that Obama does not have a real, paper Certification of Live Birth,(COLB) date-stamped June 6, 2007. Those so-called "high resolution photos" that Factcheck posted are forgeries, and not the same alleged COLB to have been allegedly scanned and posted two months earlier.

In fact, on close inspection, they are not like ANY real COLB that Hawaii has ever made. These are photos of another fabricated COLB made to support the lie that the fabribcated COLB image was genuine.

The reason why nobody has actually seen Obama's COLB is because it does not exist and never did. Hawaii confirmed that they never produced it. The people who still think this criminal forgery is real are as out-of-touch with reality as those who still think Obama is a Committed Christian and not a Muslim.

No, wait a minute. They are the same, "Night of the Living Brain-dead" Obamatons who believe that Obama is everything he says he is, and nothing that we know about him is true.

They are cheerleaders for the destruction of America. Instead of supporting our allies, they embrace our enemies. They call themselves "Democrats" but they are Communists and National Socialists, the very antithesis of Democracy, preferring despots and dictatorial regimes in third world countries than to true democracies in the West and the Middle East.

Anyone who cannot see the difference between Hamas and Hezboillah on one side, and Israel on the other, between the demonstrators in the streets of Iran and the mullahs and clerics who run the country, ought to be locked up and the keys thrown away. About Iran, Obama said that he "didn't want to interfere with a sovereign nation," yet he has no problem ordering Israel around, telling Jews where they can and cannot live, and demanding that Netanyahu bend over and take it up the wazoo while he gives Jewish land away to the terrorist thugs who have built hundreds of thousands of illegal Atab settlements in Jerusalem and the West Bank.

His supporters cannot wait to make America into a third-rate, third-world country where there is not only "sharing the wealth," but also "sharing the stupidity" and the misery they are causing.

Obama is at the head of the most corrupt Administration in the history of the entire Northern Hemisphere and is running a close second to Hugo Chavez in the Southern Hemisphere.

They are the biggest bunch of white collar criminals this side of all the Federal prisons combined. They are more than just tax cheats: they are traitors to the Constitution, to American ideals and values, to our cherished freedoms, and to our satety and security, who put the rights of terrorists above our own.

Here is how expert witness testimony works. During discovery, there are two phases: first, the “fact discovery”, when documents are requested/produced by each party, documents are subpoenaed from third parties, interrogatories are served and responded to, depositions are taken of witnesses with first-hand knowledge. Once fact discovery concludes, discovery enters a second phase, called “expert discovery.” Each party works with his expert(s) and provides to his expert the relevant documents and deposition transcripts. The expert goes to work reviewing the evidence and then writes a REPORT setting forth his credentials, what evidence he reviewed, explaining his methods, justifying how his methods are accepted in the scientific community/industry/financial community etc. and have been peer reviewed, and finally stating his opinion(s). The expert’s report IS HIS TESTIMONY.

Then, his report is handed over to the other party, and the other party gets to take the expert’s deposition. But that is not the end of expert discovery, because there is more. Now, the opposing party retains an expert — a “rebuttal expert” — who looks at the first expert’s report and methodology, and the rebuttal expert writes his rebuttal report. Another round of depositions ensues.

Once expert discovery is concluded, the opposing party may file what is known as a “Daubert Motion” seeking to preclude the report from being admitted as evidence. The Daubert motion lays out the case for challenging the expert — on his credentials, his methodology, his failure to consider certain evidence, etc. If the expert fails scrutiny on any of these grounds, the court will rule that his report is inadmissible. Game over. The party offering the expert will be up a creek without an expert. THIS IS WHY POLARIK WILL NEVER SIT IN A WITNESS CHAIR. HE WILL NEVER SURVIVE A DAUBERT STRIKE.

First of all, I’ve been an expert witness in court before, so you can quit reading stuff off of Wikipaedia.

What I was, in effect saying, is that there hasn’t been a lawsuit yet in which I would actually get to testify as an expert witness, so I’d would not be so stupid as to show anything to the public (and the Defense) BEFORE there is even one tobegin with, and certainly not BEFORE I am asked to be their expert witness.

Secondly, since you’re talking about “expert witness” as if there is only one legal definition, you’re busted on that alone.

Third, I’m no longer involved in these eligibility suits, which you would know if you actually read what I wrote.

Fourth, there is a huge difference between giving a signed Affidavit and being called in to be an expert witness in court. A legal team can bring in a bunch of expert witnesses before , or didn’t you get to that part yet?

Fifth, the forensic document expert, Sandra Lines, has already submitted an Affidavit attesting to my expertise and research findings. I would not commit to being an expert witness by myself.

Lastly, and most importantly, who, exactly, is going to get a chance to even challenge me or Sandra when the Defendants won’t even make it past “fact discovery?”

Even if it passes, Obama will predictably send in his lawyers to argue that he cannot be required to produce a birth certificate ex post facto. Sure, it’s a new election, but he’s already in office and can’t be required to do it.

It’s the mirror image of the understanding that a president already in office isn’t eligible to serve a third term even if a constitutional amendment is passed, since it doesn’t apply to someone already in office.

Not that Obama isn’t capable of having it both ways. But it would be illegal if he does (though not the first time).
