Today, the United States Supreme Court scheduled the case - Leo C. Donofrio v. Nina Mitchell Wells, Secretary of State of the State of New Jersey - US Supreme Court Docket No. 08A407 - for a conference of the nine Justices. The conference is a completely private affair and the public may not attend. If four of the nine Justices vote to hear the case in full, oral argument may be scheduled. The conference is scheduled for December 5, 2008, ten days before the meeting of the Electoral College.

If Obama is seen by the Supreme Court as ineligible, or if just enough doubt is cast, it could cripple him, and that is good.
If he does have to step aside, it wouldn't matter which Democrat ascends, there will be no credibility whatsoever. The big bullet will remain in the bleeding foot for the next four, and perhaps more years.

Biden would be better. He would be completely ineffective. He has no perceived mandate and no starry-eyed cult followers. Plus he is just a doofus who nobody takes seriously.

Do you think that the justices are afraid of being known for having influence? I don’t. It’s possible that they revel in their power. I don’t really know. I certainly doubt that they shrink from it, though.
If it were me, I would worry more about being known for allowing a non-citizen to assume the Presidency when I could have stopped it. An anti-American non-citizen with VERY strong ties to admitted terrorists.
Maybe he really is a citizen, but he has to prove it. The cloud of doubt hanging over him will continue to hang over his Presidency if he fails to show the BC. The court should force that issue.
This has nothing to do with “stealing” an election and everything to do with upholding the Constitution. I’m pretty sure the justices are all for upholding the Constitution, regardless of their political leanings.

Don't hold your breath my FRiend. This has all the smell of the fix being in. There is no legal precedent for this area of Constitutional Law and the Supremes may decided that there should not be any. In fact they may say there is no fowl of the law because he has not been sworn in yet. Odd thing the law. This particular case has an interesting slant and may not give them room to wiggle if they take it. In any case the outcome will be interesting. If they saw the One cannot be President there will be cries of court's stealing the people's will and if they say he can be them the rule of law will seem to be crushed. Fine mess the arrogant puke has gotten us into. The founding father's IMHO never believed anyone would have the stones to run if they were not natural born so they did not make this a very well defined specific requirement.

Chief Justice: Okay, folks. How many want to be known, forever, for affecting the results of yet another election, this one against a very sizable and clear majority of voters?
This is why SC justices enjoy a life appointment... to disconnect them from the pressures of public opinion so that they may freely interpret the law.
besides... they know just like the dems know that public opinion is more fickle than a bubble headed beach blond on Bay Watch.

But, and this is a huge but, if the USSC rules AFTER 1/10/09 that Obama is not qualified, then I have no idea what happens. THAT would be a true Constitutional crisis. It is only a constitutional crisis if the Constitution is not followed.

If the justices regonize that the canstitutio has been challenges, I think they will rule together and make a strong argument for fraud and deception. Do wish that they were looking at Berg and Keyes at the same time.
How long to get the Keyes case before them?

If he is ruled ineligible who will be the president elect?
1. Can it be Biden as he wasn’t even nominated?
2. If there were no democrat eligible that was nominated then who would it be?
3. Are the police prepared for the rioting that most definately WILL happen if he is ruled ineligible?
This is why it should have been taken care of a long time ago. Before a potential candidate can even be considered he/she should be required to prove their eligibility.

I hope they do take this case for their own sake. Nothing can stay hidden forever, lies are always revealed. If they don’t take this case and someone comes up with the BC and it says that Obama was born in Kenya, the Court will then have lost ALL credibility, and ALL of them will have spat the Constitution.
If Obama is a natural born citizen, so be it. But with this kind of suspicion surrounding him, they will have more than just the wrath of the Obama nation to deal with.

I heard the last Donofrio interview and he said that McCain is also not eligible. I looked at my pocket Constitution and 'natural born' isn't defined. I suppose everyone knew what it meant at the time it was written. The Supreme Court could study the matter and decide on the real meaning of 'natural born.' If both are disqualified, then I suppose the whole election would be invalid.
