I'm hoping someone may have a way of finding an attorney that I can hire to sue my HOA and management company for damages. I have more than one family that will be seeking damages for non enforcement of the covenants in our subdivision. I have been trying to sell my home and have received feedback from multiple buyers about conditions in the development that I had previously reported. The board decided to waive fines on one particular party that had 108 violations. New board members are friends with this family. Secondly they are not responding to additional submittal. The...

A Florida veteran who is facing foreclosure for insisting on displaying a small American flag in a flower pot on his front stoop is telling his homeowner's association to "bring it on." “The flag is worth fighting for,” 73-year-old Larry Murphree, of Jacksonville, told FoxNews.com Friday. “If they want to foreclose, bring it on. I’m getting calls from all over the county to stand up. That’s what I'm going to do.” Murphree's homeowners association at Tides Condominium at Sweetwater began hitting him with fines of $100 a day last year for violating his homeowners association’s flag display rules. But instead...

A Jupiter man fighting to fly the American flag on a pole on his property is claiming victory in a judge's decision to award his attorney legal fees. But the win for Boca Raton attorney Barry Silver's success in a foreclosure action appeal is part of a larger war between George Andres and his homeowner's association that isn't yet over. Silver, who five years ago took on Andres' case pro bono, Thursday was awarded $126,225 — twice his regular fees. "I hope that this teaches homeowners associations you just can't do that," Andres, a former U.S. Marine, said. "You can't...

Gov. Bill Owens signed a measure Monday that clamps down on homeowner associations after lawmakers heard horror stories about high dues and autocratic leaders who tried to oust dissidents by foreclosing on their homes. The measure (Senate Bill 100) requires associations to open their books and post notices of meetings and limits their ability to seize property. Owens said he signed the measure because lawmakers agreed to water it down. Owens said many people belong to the associations because they want their neighborhoods regulated. "It ended up doing some things good homeowners' associations already do," Owens told callers on KOA-AM...

GERMANTOWN, TN -- The city government in this Shelby County suburb doesn't want to stop at the sidewalks and curbs. It wants to creep into private driveways and garages. Proposed Ordinance No. 2005-9, drafted by the Germantown Neighborhood Preservation Commission, is full of ideas to keep the city's neighborhoods nice: no holiday decorations 30 days after the holiday, grass maintenance guidelines and hidden garbage can requirements. But it would also make it a crime to leave your garage doors open or park any motor vehicle in your driveway, punishable by a fine of $50 a day for every day there...
