Good sign if immunity is saved for last. Suggests a political earthquake. Which is what I’m expecting, after the circus in Manhattan made an absurd mockery of the justice system. After that fiasco, Roberts — a consummate institutionalist, if anything — likely moved decisively in Alito’s direction, favoring broad immunity. That’s my read of the tea leaves, FWIW.
You may be right, but a little birdie tells me this will be much broader than some narrow ruling on process. It wouldn’t meet the moment. In light of the blatant abuse of the legal system in pursuit of political ends, SCOTUS may now seize the opportunity to remove courts out of the political arena as much as possible.
BINGO! And the US has extradition treaties with a large number of countries. Without broad presidential immunity, imagine the potential havoc by troublemakers.
After the embarrassing Manhattan clown show, that ship has sailed. If a majority was inclined towards limited immunity, that all changed. It’ll be a much broader affirmation of immunity.
