Dan Rather just read these words from Stevens "we will never know who has won this election". These words, he says, will be brought up tomorrow and ever again by Bush opponents and that he is now the first questionable President elected. Some of the most blistering language casts shadow over this election. The identity of the loser is the nations judge. "I think a lot of democrats will pick up on this refrain and we will hear it over and over again."

According to a lengthy court on CBS Breyer voted against this decision because it does not provide Gore with any way to proceed for a recount. Breyer says that this decision effectively blocks Al Gore forces from having any recount because the 12/12/ date is mentioned. Even if standards could be setup to satisfy the court it is too late.
