BREAKING: Justice Sotomayor Blocks Enforcement Of The HHS Mandate

This just in from the Associated Press,

WASHINGTON (AP) — Only hours before the law was to take effect, a Supreme Court justice on Tuesday blocked implementation of part of President Barack Obama’s health care law that would have forced some religion-affiliated organizations to provide health insurance for employees that includes birth control.

Justice Sonia Sotomayor’s decision came after a different effort by Catholic-affiliated groups from around the nation. Those groups had rushed to the federal courts to stop Wednesday’s start of portions of the Affordable Care Act, also known as Obamacare.

Sotomayor acted on a request from an organization of Catholic nuns in Denver, the Little Sisters of the Poor Home for the Aged. Its request for an emergency stay had been denied earlier in the day by a federal appeals court.

The government is “temporarily enjoined from enforcing against applicants the contraceptive coverage requirements imposed by the Patient Protection and Affordable Care Act,” Sotomayor said in the order. She gave government officials until 10 a.m. EST Friday to respond to her order.

Sotomayor’s decision to delay the contraceptive portion of the law was joined by the U.S. Court of Appeals for the District of Columbia Circuit, which also issued an emergency stay for Catholic-affiliated groups challenging the contraceptive provision.

The White House did not comment on the order Tuesday night. Sotomayor issued the order a few hours before leading the final 60-second countdown and pushing the ceremonial button to drop the New Year’s Eve ball in New York’s Times Square.

A spokeswoman for the Becket Fund for Religious Liberty, the lead counsel for the Little Sisters of the Poor, said the group was delighted by Sotomayor’s order. “The government has lots of ways to deliver contraceptives to people,” Emily Hardman said in a statement. “It doesn’t need to force nuns to participate.”

That about says it for me too.

It was the right thing to do, and she did it. However it leaves me wondering where were the other 8?
Why did she have to do it alone? Where were the so=called Conservatives on the Court?

It will eventually end up in the Supreme Court, and how will the majority vote? How will she vote, when it rally counts?

Amazing, isn't it!! This truly is the power of prayer at work, even on stony hearts. The Little Sisters of the Poor maintain homes for the poorest of the poor. They had already decided to leave the US if the mandate was not overturned.

That's how are Court is supposed to work. A single Justice rules on emergency stays. The other 8 (or more likely, the conservative 4 plus a swing vote) will rule when the case is heard, and this is almost certain to get there.

She has a lifetime appointment beholden to nobody...I seriously doubt she is letting anyone "decide" for her how she rules on issues...

It's bad insurance to cover expected events or elective ones. Contraception being covered takes away the competitive factor which kept prices low Forced coverage benefits pharmaceutical companies by creating an environment where they can raise prices. Covering morning after pills and giving even the youngest girls birth control like it is candy can only contribute to the decline of morals and disappearance into chaos and debauchery of poor and minority neighborhoods. From a religious standpoint it's impossible morally to sign up for the insurance.

Maybe Sotomeyer is serious enough about her religion to not want to burn in hell. Maybe others in minority and poor communities will wake up and realize that this is social engineering at its worst, designed to eliminate them and replace them with more complacent invaders. I pray so; otherwise how can God ever be on our side?
