Enjoy.

I have, unfortunately, come to the conclusion that its going to take a civil war to restore the liberty of the "original intent." The enemies of freedom are going to continue until the Republic is nothing more than a word; the Constitution nothing more than a "quaint, historical document" with no real meaning, except whatever the ruling elite wants it to mean at any given moment. The usurpation of power by the judicial branch has become striking; creating law out of persanal whim is the forte of the US SC and the entire Federal Judiciary. And it has been so for at least the last 50 years. And there is no help in the US Senate, because at least half the members of that august body are in total agreement with the courts and will work to see that the
status quo is preserved. The entire ballot process has been rendered worthless. The fourth branch of government, "We, the People" has been disenfranchised by the professional political class of the other three branches.
That is why the California Recall is an interesting phenomenon; it is a process that has ALL the major power-brokers nervous because they can't really control it. But sure as the sun will come up tomorrow (God willing), you can look for the bastards to try to destroy the recall provision of the California Constitution as soon as the dust settles. And the courts will be only too willing to help with that little task.

Excellent analysis and presentation. And damn good reason to vote for people with Rs behind their name.

Thanks for this wonderful article. I completely agree that this is about judges.....judges who may believe that they are gods. If we Americans don't begin paying more attention to judicial elections/appointments, we may find that the America we love is no more. I can't bear this thought. I have been calling and emailing Senators and Congressmen about the disgraceful filibusters of the President's judicial nominees. Why is it ok to have liberal judges but not conservatives?? But, I'm a drop in a bucket. I've also asked the RNC why they are not coordinating efforts of state and national party to have a massive grassroots movement to stop the filibusters. Sadly, I get lip service and see no action.

I had no idea that the Congressional action you describe was a feasible alternative to re-populating the court or a constitutional amendment.
And what an elegant solution it is.

Anyway, that's what I think, as a citizen and a lawyer. I knew it! I just knew it! There is at least one good ethical lawyer out there.
I'd move to Western Carolina to vote him into Congress if I could find it on a map.

Very nice piece, and a practical solution. The Constitution gives Congress a check. It's about time the Republican majorities get their act together and start to use it.

Well, you know this nation was founded on Religion/Christianity, the Right to property, tradditional Marriage, and Slavery. We all know what happened when slavery was ebolished (it was a good thing)... but when the Fed Gov trys to destroy three of the original conerstones of the US Republic at the same time, it will get interesting....

I always enjoy your posts and your columns.
I had wondered where the separation of church and state came from. I couldn't find it in any of my copies of the constitution. It always baffled me how prohibition of the establishment of religion became the hallowed "separation of church and state."
Now I know, they made it up.

Distinguishing between Patriots and cowards, our favorite Founder, Samuel Adams, said: "Contemplate the mangled bodies of your countrymen, and then say, 'What should be the reward of such sacrifices?' ... If ye love wealth better than liberty, the tranquility of servitude than the animating contest of freedom...crouch down and lick the hands, which feed you. May your chains sit lightly upon you, and may posterity forget that ye were our countrymen!"
This was quoted from most recent issue of the Federalist!

But this court denial is applied only in Alabama, not in D.C. Myron Thompson's apologists here on FR don't like having that pointed out to them.
