I have, unfortunately, come to the conclusion that its going to take a civil war to restore the liberty of the "original intent." The enemies of freedom are going to continue until the Republic is nothing more than a word; the Constitution nothing more than a "quaint, historical document" with no real meaning, except whatever the ruling elite wants it to mean at any given moment. The usurpation of power by the judicial branch has become striking; creating law out of persanal whim is the forte of the US SC and the entire Federal Judiciary. And it has been so for at least the last 50 years. And there is no help in the US Senate, because at least half the members of that august body are in total agreement with the courts and will work to see that the status quo is preserved. The entire ballot process has been rendered worthless. The fourth branch of government, "We, the People" has been disenfranchised by the professional political class of the other three branches.

That is why the California Recall is an interesting phenomenon; it is a process that has ALL the major power-brokers nervous because they can't really control it. But sure as the sun will come up tomorrow (God willing), you can look for the bastards to try to destroy the recall provision of the California Constitution as soon as the dust settles. And the courts will be only too willing to help with that little task.

Aye! Law by judicial fiat. That is what it has become. The judge makes a law, out of thin air, and voila! in come the marshals to enforce the "rule of law". Say what?

You know, I am listening to Fox News and they are saying that we are a nation of laws, etc, etc, and I say to myself, why yes we are, but what laws? When a judge says something is that a law? Is he ruling on the law? If so, what law. Legislatures make laws, not judges. But it seems that nowadays it is the other way around. I am truly troubled by this. But what to do...

The case in Alabama is a striking example. A federal judge makes a "ruling" and it is a law? What law is being enforced? What law is he ruling on. The Constitution says that "Congress shall make no law..." so what law is this federal judge ruling on? Hmmm? Would someone out there tell me. I am open to instruction.

This is a topic that needs to come out of obscurity. It should be a matter of serious discussion. Your analysis is right on the money.

First I want to say that I don't claim to be a prophet or a psycic. I don't even believe that my dream means anything, but when I read your post I thought of a nightmare I had when I was a senior in high school. In my dream we were going into another civil war in America, I don't know what the war was about, but I remember that in my dream the year was 2004.

America needs a wake up call, I hope that wake up call is not a war!!

Well said. We freepers sometimes think that the Constitution somehow protects us from tyranny, when in fact we are protected only by a partisan band of 9 justices appointed in the normal process of political give and take. As soon as you have 5 who cannot read the plain intent of the Constitution, then the beginnings of tyranny are present. We have long since passed the point of no return with regard to the Constitution, we are getting rolled almost daily now. I'm afraid the Christians will pretty much go away without a peep. But, we deserve it. We have for too long wanted to wash our hands of the politics necessary to preserve our liberty.
