Legal Tragedy for Unemployed Divorced Men & Fathers

Posted on 08/17/2003 2:34:43 PM PDT by ImFightingMad

I am writing this to make this Legal Tragedy better known and also in hope that someone could help the thousands of us in this tragic situation.

Like many Americans at this time, I have been laid off. This in itself is bad enough for most Americans, but those of us that have been divorced face a Legal Tragedy that is against The Constitution and all moral concepts. Men are almost exclusively affected by what I am about to tell you. This shows the discrimination of the courts and the laws in this country.

Since I have been laid off, I am only “earning” unemployment insurance, which is only 16.6% of my previous gross income. I therefore cannot pay the alimony and child support that the courts ordered in my divorce in Florida. I do not even have enough money for my own expenses. The courts in Florida are looking at finding me in contempt of court because of non-payment. They would therefore put me in jail along with countless others for the same reason. This makes no legal or moral sense in many ways:

1. If I was still married and got laid off, would the courts care, of course not! The family would have to do what they could to survive. But, since I have been divorced, and there is no relationship anymore, I’m supposed to support them over supporting myself, otherwise go to jail. How does this make any logical, moral or legal sense? Why is it that since I am divorced I have a greater financial responsibility than I ever did when I was married? Why should all of my rights be taken away because I am unemployed now, and yet my ex-wife is suppose to maintain the same or better lifestyle as when I was employed? This again, would not be the case if I were still married. This shows that divorce laws take precedence over basic human rights and are stronger laws than marriage itself, which is a bond with God.

2. If I’m in jail, how am I supposed to find a job? After being in jail, it would be very difficult, if not impossible, to ever find a good job again!

3. This type of incarceration was abolished with the 13th Amendment. Which prohibits Involuntary Servitude. Also 8 USCA-56 prohibits Peonage.

Why should my life and other’s be completely destroyed just because we were ever married and now unemployed?

Isn’t the fact that I, and many others have lost our jobs enough of a tragedy in itself? How does completely destroying the rest of our lives solve anything? In this situation, what could any of us ever do to help ourselves?

I was extremely involved in the 2000 Presidential election, supporting George Bush. I lived and worked in Austin, Texas, but I was still a registered voter in Florida. The government and country that I so dearly loved and put so much energy into, has now let me down.

Please Help!

I used to work for a 30 something divorcee a few years ago. She clearly detested marriage and men and surrounded herself with other divorcees who also felt the same way.

One of the clients we did work for was a bank and our contact at the bank was a woman in her younger 30's and married to a very wealthy man. Fully maintained, giant rocks on her fingers, designer suits to her "little bank job"

Well, one day the man haters got wind of the fact that she was divorcing the husband. They were in all their glory, couldn't stop talking about the great little condo she got down the street from the former house, etc.

Well, I was dumbfounded. I could not figure out why someone who was so well "kept" would rock the boat. I was still trying to figure out why she bothered with the bank job.

They all thought I have pretty naive. "Why would she stay married if she can have all that and not be bothered with him?" was the general consensus. And, yes there was a 3 year old child involved.

American women my age 35 or younger, think they're "goddesses".

Actually it's not completely their fault. They've been told that by Cosmo, Oprah, and Lifetime, over and over and over...

So should the woman who had the kids. If she couldn't afford to feed, house, and cloth them, she should've kept her legs closed. Why do you assume that the man alone is totally responsible for her sex acts?

Because to 4IndenturedServitude4Guys all men are rapists?

You don't have very good reading comprehension - do ya? I explicity stated - I'm a serial monogamist.

,,, help me out with my disability. What's the number of the particular post where you said that?

"Child support - Si!
Alimony - No!"

I say, "Support, alimony, same thing," or "support/alimony,"
because that's what it was devised for, and that's how it
works. Most women below upper middle income class get more
pay than the men in the same income class get, due to AA
and corporate policies.

Go post your anti-marriage crap on some other bulletin board.

Go walk a couple millimeters in the shoes of some one who's been there. Then get back to us...

hmmm...im new to posting so im not sure if your being sarcastic?? lol
it would be great if the truth would always come out, unfortunatly the same ppl that screw up the courts for the good parents are still going to lie. my point was no fault isnt the problem, the judges are and the parents that are more intersted in poking the other parent then they are thier kids!
my x would quit his job, starve if he had too just to get to me and hes proven it again and again. its not about his child its about making my life a living nightmare! he has even laughed in my face about how he scammed the evaluator doing the parental evaluation.
for every group of good men fighting for thier rights there is another man group thats equivelent to the nasty women at NOW. my x belonged to one as he bragged about the above. i finally went into thier website and they advocate using alienation as a "weapon" gave books out for free on how to prove it even when it doesnt exist, how to get money in court for it as well. they also advocate "touching your children" if you get my drift. sick bunch of guys! anyways, sorry for the rant. im just frustrated with courts in general because no matter who you are its biased one way or the other and its set up to keep the litigation going, why be amicable when you can clean your x spouses clock? those of us that would rather work it out nicely seem to be married to those that have no mercy.

Where I come from partners are in law firms and the better accounting firms. People who are married with children are not partners, but instead parents, spouses, beloveds....

Of course, in an intact marriage both parents contribute enormously to the well being of a child. I was not talking about an intact family but a separated one.

Will I ever get married again? Well, if the choice is Marriage, versus Drawing and Quartering, Maybe. But short of that, Probably not...

I don't have any magic bullets, other than to tell you that I will keep you and my friend at church in my thoughts and prayers.

And would give you a bed and dinner if you ever come to the DFW area in Texas.

I can't imagine the anguish you're going through, but I'll help any way I can.

I thought it was just us guys that went through these "mid-life crises".

Yes it is happening to thousands of men in this country. In New Hampshire too. I read a newspaper article about this just last week. I am recently going through a custody case over my son. I have Primary custody as a father. My ex has had three court appearances on why she has not paid child support and never even have has a slap on the wrist. She is an LPN and capable of making $45k a year but instead, chooses to not work and rape the system including filing bogus domestic violence charges. This last time, the marital master gave her temporary custody and order me to pay support based on a false charge even though I had hard evidence it was false. Also, this mother of our son moved 6 times in 2 years, 2 times out State is currently unemployed (I make $70k a year) and still granted custody. Unbelievable! Very strange sickness going on with the courts supporting the destruction of the male role in society. Sorry to hear about your plight brother, you ain't alone and it IS NOT RIGHT.

Better yet, get one of those Pali bomb belts and at the next hearing take the damn judge out too!

They search everyone on the way into the family law court building here. Sorta a tacit admission that a lot of people are REALLY PISSED about the way the courts treat them...

Thank You.....my ex is now going thru a divorce with the once very wealthy older man she left me for and refuses to talk to me about it and berates my 14 year old daughter who wants to live with us down here.

If you let it...it becomes a nightmare...a costly one.

At least I only have 3.5 years more of this shite.

Why did I marry and procreate with her. She was beautiful and I thought i could make anything work back then.

LOL...now I know different. The only person who despises her more than me is my #2 wife of 7 years who loves the girls and loathes how my ex raises them. It's a travesty and we are helpless to do anything about it.

Like I said, she drops dead tommorow and I'd work hard to help my girls with the trauma but I'd light up a big stogie first. She is a completle neurotic and unbalanced shrew who should be on a Prozac drip.

surplus ectoplasm in my view...

we need to regain our balls, women have literally eaten our lunch in the divorce wars and gutless irresponsible men have played right into the media's hands on this one. All you ever hear about it is men shirking parental responsibility or cheating with younger women (who are miraculously held as innocent participants)....what a crock!

I would only venture that women naturally raise nursing babies and very young girls better than men but beyond that, it often depends on the parent...not any inherent gender specific conventional wisdom.

Do I sound bitter?

Hell yes....this topic is the absolute only thing in my life that has ever essentially beaten me and left me just "licking my nuts" metaphorically. It is a dagger in my heart to watch my children raised poorly in a tumultuous environment and be 99% helpless to stop it short of incurring a class A felony beef.

It sux....all you young horndogs out there wishing to spread yer wonderful genetic material into the future:

BE VERY CAREFUL....YOU HAVE CHILDREN...THEY HAVE YOUR HEART FOREVER....BUT YOUR WIFE OWNS THEM TILL THEY ARE 18...NOT YOU!

"hmmm...im new to posting so im not sure if your being sarcastic?? lol"

No. I was being dead serious.

"it would be great if the truth would always come out, unfortunatly the same ppl that screw up the courts for the good parents are still going to lie."

...not if we shove due process down the throats of our
treasonous divorce lawyers (who use the doublespeak,
"family law" lie). ...evidence and credible testimony.
They don't want to deal with it in their courts,
though, because they are lazy, greedy and morally
bankrupt.

Susan B. Anthony and her nasty, racist, man hating, family
hating, "free love" dishonest friends wanted easy
divorce. That was the beginning of the immoral,
socialist ushering divorce courts we have today.

Liberal men and women, whether they disguise themselves
as conservatives to subvert the Republican Party or not,
do not need easy, frivolous, dishonest divorce, and we
don't have to keep putting up with the destruction of
the family or the entrance of socialism from them.

They follow the devices of Marx and Mao.

What nice language!

No, men should not pay more. Most mothers work caring for the child counts as provision too. Or do you think that the work of mothering is to menial or worthless to have a financial value attached>

That I do not recommend. Stay strong for your kids and do time for them if you have to, a short county farm stay in the steel pagoda is not worth never seeing you kids again. It will not go away brother. Prayer in Christ does help brother.
