So, if Davis resigns, and Bustamante becomes acting governor, is he then also ineligible for the replacement election (as Davis would be if doesn't resign)? IOW, if Davis quits, and the recall succeeds, could Bustamante graduate from acting governor to governor if he wins a plurality in the second question? Also, if Davis resigns, would he then become eligible to run in the replacement election?
First question: Yes, Bustamante could go from Lt. Gov. now, then to Gov. after Davis quits, THEN "graduate" to serve the rest of Davis's term if the recall succeeds and Bustamante gets the plurality on question 2, as I understand the law.
No on the second, if only because the state constitution says that no governor may serve more than "two terms" -- not, by way of contrast, no more than "two FOUR YEAR terms." And Gray's second term would end immediately if the recall (question 1) passes.

Executive summary: MSNBC and other cable news outlets said that Gray Davis would be giving a press conference at 5 pm EDT.
MSNBC later reported that it would be delayed until 6 pm EDT.
Sacramento news radio reported that it would be 6:30 pm EDT.
MSNBC reported that the California Supreme Court would issue a ruling on the recall issue at 7 pm EDT.
We're all waiting for both that ruling and the Davis press conference.

I'm not taking a position on whether McClintock is or is not a good candidate; I'm not from Cali, and it's not my place. I'm just curious why, if he's a major player, none of Hume's panel mentioned him. He doesn't have an ice cubes chance in Hell! Grey Davis' smear machine will paint him as a racist rebel flag waving ultra-conservative Hellbent on deporting everyone Californian with a Spanish surname at gunpoint. Frankly, his candidacy has no traction outside of his supporters here on FR, and from what I have seen he lacks the charisma and war the chest to compete with Davis (who is free to raise unlimited funds through campaign contributions while his opponents are subject to campaign finance laws.)
He's a non-starter. Some of us Californian's are delusional.

Look, the conflict of interest, IF ANY, was on the part of the Davis team. They knew that their negotiator
had been a consultant (not an employee) to power companies. That's what qualified him to be a negotiator. He knew the business.
It is well-settled law that a party may not claim conflict of interest to get out of a contract when they knew about the supposed conflict at the time. Otherwise, you're providing an incentive for every party to sneak a conflict of interest into every negotiation just in case they want to get out of the contracts later.
In addition, you have to show that the conflict of interest actually caused damage. There is no reason to believe that the contracts didn't represent market value at the time they were entered into. You might recall how Gray Davis was bragging at the time that they represented a substantial discount over current power prices. Which was true.
The problem is that only idiots seek to lock in long-term supply contracts during a time of shortage. Markets always correct themselves and prices do, too. So, Gray Davis is an idiot. He locked in higher prices than a smarter businessman would have. But that doesn't make the contract not a fair contract at the time it was entered into, anymore than locking in a low price during a time of surplus makes that contract voidable.
The contracts were legal, and the conflict of interest claim will not fly legally.
