It is an issue because the family has said she NEVER wavered in her story and description of the man. And she never did. MK saw in the darkness a gun and stuck to her story. Now we know through Elizabeth that it wasn't a gun, but a knife. What difference does it make what it was?

Yes, many states are beginning to move away from the notion that minors lack capacity to contract. I believe Wisconsin was an early leader in this trend.
