Catholic League president William Donohue commented on the decision reached today by the 9th Circuit Court of Appeals upholding a challenge to its decision banning the Pledge of Allegiance because of the words under God. Here are his remarks:
Two things need to be done immediately: teachers and students should practice civil disobedience and the judges must be impeached.
It is up to the teachers in the nine western states affected by this decision to break the law: they should instruct their students on the meaning of civil disobedience and then practice it. All they need to do is call the cops and local TV reporters and then recite the Pledge of Allegiance in their presence. It needs to be shown on television all over the world that as the U.S. prepares to go to war to maintain the liberties symbolized in the Pledge, there are brave men, women and children at home who are prepared to fight tyranny on our own soil.
Iraqs problem is tyranny of the minority. Ironically, thats our problem as well. But the Iraqi people at least stand to be liberated and have their tyrant deposed. We need to do the same with ours, albeit with different means: impeachment proceedings against the two federal judges who made this decision should commence as soon as possible. Make no mistake about it, it is not enough for the U.S. Supreme Court to overturn this ruling. Judicial malpractice has been committed and those responsible must be removed from the bench. They should be removed not because most Americans disagree with them but because of jurisprudential incompetence.

Except that the judges forbade anyone from using the words "Under God" under penalty of law.
Well, they didn't, but if we say that they did then it sounds meaner and it justifies being vindictive. Quite a few people spent some time insisting that the ruling made it ILLEGAL for anyone to use the phrase "under God" when uttering the Pledge. In other words, quite a bit of the backlash is based on willful ignorance.

It's not slapping communism that's the problem, the problem is that it was a completely misguided effort. The implication that only communists lack belief in a god is degrading, insulting and pig-ignorant.

Given that many people who claim a belief in a god have differing and sometimes even mutually exclusive definitions of this "god", I must ask to which God you are referring?

To remove a Federal Judge you would need to get him/her certified medically unfit (which would bar them from hearing cases), get him/her convicted of crimes and doing jail time, or impeach and convict him/her for high crimes and misdemeanors in the US Senate. There is a very low probablity of any of these happening.
But FR is famous for outside-the-box thinking. And I think there is another way.
The power to create the Circuit Courts lies with Congress. The funding of the Courts lies with Congress. Congress is entitled to "devolve" the 9th Circuit. Basically, through legislation, the 9th Circuit is eliminated and a new set of courts created to replace it. There is no obligation to transfer, relocate, or otherwise move the judges, especially if Congress specifically states that the present judges are retired with full benefits (no "harm" or "injury").
Congress passes the law, the President signs it and good bye #9. However, you know the dumbocraps would raise holy hell. This is their pet court (along with the DC Circuit).

Its quite simple. What kids have done for decades is now banned. The pledge has been censored.

I'm a Christian. I say the pledge.
But you know, are we really "One Nation, Under God"?
No. We are "One Nation, Under a Constitution". We don't even act like we are "Under God" considering all the sin and immorality in our government and daily life.
"One Nation, Under God" is not just inaccurate from a constitutional perpsective, it's also a lie.

I am old enough that when I learned the pledge, the phrase wasn't in there. Adding it was a pathetic little slap at "Godless Comunism" and acomplished nothing except to break the word flow of thte pledge and cause division among Americans.
It is past time to take it out and use the original pledge.

I also am old enough to have learned the original pledge and I agree the phrase "under God" is an unnecessary divisive distraction. We should use the original version of the pledge.

1. its no lie: we are "under God" whether we acknowledge it or not
2. the pledge is not and never has been a constitutional document, it is a popular expression of our values, and being "endowed by our Creator" with inalienable rights is an important value the pledge acknowledges

My understanding is that the 9th circuit decision has been stayed pending an appeal to the U.S. Supreme Court. Hence there is no Civil Disobediance involved. Teachers who say the old "unlawful" pledge are not breaking the law. Indeed those who change the pledge to exclude the reference to "under God" would be violating the Congressional mandate which requires that the pledge include those words.

This judgment is a gift to the left. The fringe on the right may just see this as some kind of biblical threat to our way of life and behave in such a way that the centrist, moderate, libertarian and economic conservatives will have to disassociate themselves from them.
As much as I dislike it, I have to admit that its the ONLY brilliant thing that the left had done in years. Divide and conquer

I think youre generally right. This is like the anti-flag burning law/amendment issue. More symbolic than substantive. It brings out the hot headed emotional side of the RP, not our best public face. This is not the hill I want to die on.
