NJ.com reporting Sen. William Frist, chairman of the Senate GOP campaign committee, said Republicans would consider appealing to the U.S. Supreme Court if the New Jersey court rules in favor of Democrats.

Congratulations, jayef. You have gotten to the Heart of the Matter.

What is happening now in New Jersey is the ultimate triumph of democracy (aka, Mob rule) over republican government. Our understanding of history has been so degraded that our people no longer know the difference.

This is one of the reasons I shudder whenever some dimwit politician waxes poetic about "exporting democratic values" to benighted parts of the globe.

Two of these Judges are contributors to Torch's campaign. They should recuse themselves. I believe one of them also contributed to Lautenberg awhile back.

This lawyer is not answer the question very well.

He should tell them the legislature did think of vacancies within the 51 days and the law intentionally does not provide a way to replace them.

The Republicans should ask if they can substitute Tom Kean if it appears that Forrester is losing to Lautenberg.

The Dems would love it if it helps to destroy election law. Publically, they would denounce it.

I do have a question...has anyone made the point to the court that if Lautenberg's polls next week show he's 20pts behind, do the RATS get to pick another candidate?

The justice's argument that the statute only provided a procedure for 51 days and out but left open 51 days and in is moronic. The clear implication of the statute is that less than 51 days prior, you CAN'T name a new candidate.

If the legislator wanted to leave open the possiblity of substituting a candidate less than 51 days before, they would have said that.

Any judge who relies on this reasoning is nothing less than corrupt. This is truly depressing. It really seems that we are not a country of laws. This is purely political. Disgusting.

This lawyer just addressed what I said yesterday could happen.

Answer: He did not resign. He will finish his current term as Senator. He said he will not be a candidate in the election.

So the way I look at it, if they cannot get his name off the ballot, and with him going out in public saying don't feel sorry for me and crying, he will get the sympothy vote and win the election.(I sure hope not) So even though he said he wasn't a candidate he will say the people want him and accept the election.
