Big deal, it's a desperate move on the RATS part. Don't know what their angle is but this won't change this race. If anything the next move they make makes them look like a Torricelli. A fraud, a liar, a thief !

First Florida two years ago has the Rats challenging every dotted I, each crossed t and now I can see them and their lawyers making a mess of the New Jersey election laws. Soon under these conditions Democracy will be a thing of the past because no regulations or laws can be written so tightly as to prevent some corrupt individual or party from probing, testing to get every advantage.

The order is maintained from people realizing and abiding by the intent of the legislation. But of course show me a Democrat willing to abide by the intent of the election rules.

Oh how I hate them so. May they burn in the fires below.

I have to share this.

My staunchly Democrat best friend told me tonight she had had enough of the incredible garbage of the Donkey Party.She was furious about the 3 traitors in Baghdad.She got enraged when I filled out the "rest of the story" re the NJ naked power grab(2000 redux).

She will now vote "R" unless she has an explicit reason to doubt them personnally.

Theere is hope for this country!

It was a joke. You wrote a critical letter to that crook Torricelli, and I was thinking of how Torch went into a 7-11 with a mob guy to try and intimidate David Chang. Just a wisecrack playing off that incident, that's all. Sorry if it wasn't too clear.

I don't think it will be a matter of sympathy so much as fear that a Republican of any sort would gain the seat.

As it was, there were still a whole lot of Democrats that were planning on voting for him anyway. The ones that weren't up to this point might change their minds now, if they can tell themselves that they are really voting for McGreevey's pick. In other words, they would rather take their chances on McGreevey picking someone they would like even if they don't know who it is than to let a Republican get the seat.

Again, the scenario that I'm worried about is this:

They scramble and find someone strong willing to take his seat for now under an appointment from McGreevey. Toricelli holds on for another week or so and then announces for the good of the party that he will resign from the Senate. This allows McGreevey to appoint his replacement. Toricelli's name has to remain on the ballot, but people can vote for him anyway, knowing that he's not really the person they are voting for but the person McGreevey picked will be once the swearing in is done next January. This buys them a year or two to really put together a campaign with a strong candidate while Dashchle et al can hang onto the seat that would have been a total loss otherwise.

Or at least, that's what it's looking like to me the more I think about this. They have to see more of a chance to preserve the seat than simply hoping the NJSC will rewrite the law for them. They aren't that stupid.

I know the seat won't hold under this arrangement for the full six years, but I think all they're playing for right now is time so they can try to put together a stronger campaign.

Anyway, that's what has me worried so far.

I would say you've nailed the plan. Toricelli and the entire democrat party heirarchy have no integrity, so whatever they're up to is a manipulation of the truth and an effort to slip one over on NJ voters, taking NJ democrats completely for granted! Oh how I loathe the democrat heirarchy ... and I'm starting to worry about the integrity of the election process, what with the sovereign voters so uninvolved and snoozing.

I too was lurking back then in the 'Trials and Tribulations of November-December 2000..' Howlin is right it was like this EVERY FREAKING DAY (for 36 days!)

Mostly 1,500-2000 response threads it got so bad that I would log off about 4AM, sleep in my leather couch in my office and then catch the morning spin at 7-8 AM EST-I hope it doesn't come to that this time!

would like to know why she endorsed Torricelli?

I can't seem to find the thread on it now, but she endorsed the Torch because of his work with 9/11 victims. It was in a letter in Saturday's New York Times.

I was involved in the Brett Schundler litigation. That case offers the Dems no help in the present situation. In the Schundler case, the court upheld the "new" deadline that had been set by act of the legislature. In the Torricelli case, the legislature has done nothing to change the deadline. It is still 51 days.

The general proposition is that courts should obey and enforce laws that are written by the elected representatives, not rewrite the laws on the spot to suit what they think is right. If the Schundler logic is applied to the Torricelli case, the legislature's deadline will be upheld and Torricelli will lose.

Dammit! I'm tired of knocking down this argument based solely on New Jersey law. The Constitution trumps NJ law. Therefore, if NJ tries to extend the six-year term that Torricelli now has, NJ loses. Why? Because the Constitution specifies both a six year term for Senators and an election in New Jersey (because Torricelli's six years are almost up) on November 5th.

End of discussion. NJ can no more change the provisions of the US Constitution than it can pass a law and keep the sun from coming up until noon. Is that clear now?
