The View From Here

Schulz stops paying taxes, defies IRS

By CARL STROCK

I expected it would come to this, and now it has. My friend Bob Schulz of sue-the-government fame and reputation has declared that he will no longer pay his federal income tax.

In a letter to the IRS dated yesterday, he called the tax "the greatest hoax ever perpetrated by government against the working men and women of America" and said he's all done cooperating.

What's more, he told me by telephone from his home near Lake George, he is preparing to lead a national campaign urging others to stop filing returns. He will hit the road late this week or early next and drive cross-country spreading the message with the help of some 600 like-minded "coordinators" who have already enlisted in the cause.

The message is the basic Jeffersonian one of the rights of the People as opposed to over-reaching government, which has been the underlying theme of his activities since he was suing New York state over its devious borrowing practices. It was given new focus earlier this year at a hearing he held in Washington on the legality, or illegality, of the income tax.

The conclusion of that hearing, you will not be surprised to learn, is that the 16th Amendment to the Constitution, establishing the tax, was not properly ratified back in 1913, and the Internal Revenue Service, therefore, has no good foundation in law. The government has been conning us all these years.

It's a cause that Schulz got onto about three years ago, and he has pursued it since then with the same relentlessness that he demonstrated when he was badgering New York.

Since I talked to him earlier he has added to it the notion that the Federal Reserve System is part of the same sinister complex as the IRS.

"The income tax was instituted to provide lender security and guaranteed profits to this highly secretive, privately owned and unaccountable central banking system that has obtained absolute control over our country and the federal government," he wrote in his letter, sounding, I must say, as if he's gone over entirely to the kook wing of American politics.

"Most Americans are in a condition of continual economic peonage and slavery to the federal government and the privately owned Federal Reserve System," he postulated.

He said the Federal Reserve thing sounded like a "fringe issue" to him too when he first heard about it, but his own research has convinced him it's legitimate.

In responding to the perceived conspiracy to deprive us all of our liberty, he does not spare the rhetoric. "We must resort to force," he wrote to the IRS, making clear however that by force he means "a non-violent mass movement."

"An appeal to force and to the Creator is all that is left to us."

Of course this will lead to trouble.

"The civil strife is inevitable," he wrote. "Let it come! Let it come!"

Does he expect to wind up in prison as a result of his new position?

"I don't know what to expect," he says, though he obviously does not shrink from the prospect of a legal fight.

I certainly wish him the best with this battle, though in the meantime I will look to my interests by continuing to pay my own taxes.

Anyone who steps forward to lead a tax revolt must know that a crosshairs will settle on his forehead at once.

Not so! I know of numerous people who have legitmately backed out of the VOLUNTARY federal income tax system. Here's a link to one in particular:

Tax Informer

His name is Chad Prater and he has not paid federal income taxes in 14 years. He has over 10,000 clients in all 50 states, many of whom have not paid in 10 years. His method for legally backing out of the system of VOLUNTARY COMPLIANCE is the best I've seen. You may want to order his book or call him on the phone and begin your own research.

We must stop funding our enslavers!

but our taxes are confiscated by our employers before we ever see our checks.

I've heard several people advocating removing withholding so everyone will have to send in a check to the feds once a year to pay their 'fair share'. The powers-that-be certainly knew what they were doing when they instituted payroll deductions. Since people don't ever see the money, they don't miss it and, therefore, it cause them no pain to see that several hundred or several thousand dollar payment go out. I believe that if people had to send this in on their own, there would finally be a MASS uprising and refusal to pay but, alas, I don't believe it will ever happen. The power to tax is the power to destroy.

Not paying your taxes is surely one way of screwing the government. Eventually you will wind up being housed, fed, clothed, entertained, medicated, offered an education and Gyms in which to bulk up your body-eventally providing you a burial plot and funeral, if your sentence is long enogh, or you are old enough when sentenced.

All in all it's sort of a perverted rebellion, because you are also screwing yourself. Better to pay those taxes and bitch about them as a free citizen, more or less.

Oh yeah. Since 1913, the government has been taking our money illegally and, until now, no one has challenged it. And even though the 16th Amendment is IN the Constitution, it's not really there. It just snuck in by itself when no one was looking. And no one even noticed it. Oh yeah. That's believable.

There is a conspiracy, but when it transpires in broad daylight it's increasingly difficult to call it such

I guess that's what I mean. But if it's a conspiracy, it's a conspiracy of millions over many generations.

I hate the income tax, but I don't think there's some sort of ruling politburo sneakily keeping me in line. It's the damned government that my fellow countrymen keep electing, the idiots.

Why is it when a person realizes the injustice of the tax code and wants to do something about it they are usually labled as 'kooks' or a 'nuts'?

that is one of the many reasons why the government/irs can continue to deceive the american people.

like shultz says, we need a force.

Another thing that Jefferson said when our forefathers were arguing about establishing a central bank (yes, this was an issue from the very beginning). "The only thing that can destroy this form of government is the establishment of a central bank, because when one gives up control of their currency, they give up their sovereignty." He was right, we have had no control over our government since that fateful day in 1913. But, it will take stronger men than this generation has to fix it.

I hope you haven't given up on filing your taxes because, that videotape notwithstanding, the arguments in it have all been thoroughly debunked. Sorry you blew 20 bucks.

On the domestic income question, the contention in the videotape is based on a misreading of the sections they cite, which distinguish US versus non-US income for purposes of preventing double taxation by the US and another jurisdiction. They do not specify whether income is taxable or define gross income.

On the question of state citizenship versus US citizenship, that's been pretty well settled by the Fourteenth Amendment, which specifically provides that natural-born and naturalized Americans are citizens both of the United States and the state in which they reside.

Of course, none of this will prevent some people from following ignorant and discredited advice to their detriment.

Finally, I hope you aren't trusting any of the lawyers that you say found this tape convincing with any business of yours that you consider important!

Thanks for the link. EVERYONE, check this out!

(BRUSHABER V. UNION PACIFIC RAILROAD, 240 U.S.)

"The 16th Amendment created no new power of taxation and did not change the constitutional limitations which forbid any direct taxation of individuals."

You see, we've been scammed by the State since 1913. Our federal government has been lying, deceiving, and stealing from its citizens for 89 years. However, the federal income tax is not unconstitutional because it is VOLUNTARY! If we want to voluntarily assess ourselves and voluntarily pay, the IRS will be glad to accept it.

You are only required to pay if:

1) You are a U.S. citizen with a foreign income.

2) You are a U.S. citizen with income source from a U.S. federal territory, such as Puerto Rico, Guam, Virgin Islands, or Washington D.C.

3) You are foreign alien living in the U.S. with a domestic income.

4) You are an employee of the federal government.

The key to unraveling the Tax Code is knowing and understanding the operative definition of the word, "SOURCE"! If you are a citizen of one of the 50 states with a domestic income, you do NOT have a SOURCE of income.

If someone comes to the US, they do not pay tax on income for the first seven years that they are here. If after seven years they are still here they must start paying income tax.

Hey, don't worry about my $20, thank you! I'll proceed based on my own judgments, not yours. How do explain this?

(BRUSHABER V. UNION PACIFIC RAILROAD, 240 U.S.)

"The 16th Amendment created no new power of taxation and did not change the constitutional limitations which forbid any direct taxation of individuals."

Waiting for your explanation with much anticipation!

The 16th Amendment was not legally ratified. It is not a law, and we pay our taxes because we are slaves submitting tribute to our masters.

Well, why don't we start with the fact that the quote you have posted is nowehere to be found in the Brushaber decision. I've searched it several times on several sources and can't find that statement anywhere.

Then, let's take a step back and look at why Brushaber is important. It's important because that was the Supreme Court decision that upheld the constitutionality of the federal income tax.

Gee whiz! Do you people believe everything you read?
