Yes I understand this, and they were CHARGED, TRIED AND HUNG BY A MILITARY TRIBUNAL. I do not have a probelm with this guy being charged and tried by the military. This is war. However, i do have aproblem with a US Attorney not being able to make the charges stick in a Federal Court and then having the Federal Government turn anyone over to the Military without charges. NO ONE THE AG< POTUS DIRFBI has said "TO BE CHARGED". He is being detained that is all. We have a Constitution we don't want to suspend some of its provisions? Then follow it.
Yes, Mujahir IS a native born citizen. In addition, he not only confessed, there is corroborating evidence which supports his confession. He therefore changed from a little fish up on a routine charge but under suspician to a Big Fish because the suspicions about him have been confirmed.
Zacharrias Moussaoui is not a US citizen. He is a French national, who was here on a student visa ( I think it was a student visa ) Moussaoui has NOT been as forthcoming as Mujahir apparently has, because Moussaoui is attempting to circumvent US law with Islamic law. I have not heard the judge is asking for ANY such proof of federal sources as some claim. I only know the DEFENSE asked for more time, which wasn't granted, then the fed asked for more time, and it was.
The cases, charges and nationalities of the perps is different, that's all.

This is a very foolish position. In times of war it is necessary to separate crimes of war from ordinary criminal proceedings. The mere fact that he met with foreign terrorists several times is enough to convict him in a military tribunal. This is as it should be. Do you want this guy and those like him free to bomb your kids? Well your position will insure that they are free to do just that.
I dont know that they are charging him with treason, only with conspiracy to kill Americans, lower threshold. They also arrested his conspirator in Pakistan. If they knew what the two were talking about and were tracking him all the way through the Middle East and Europe before he came back, I would think they must have done some electronic surveillance on him.

First I have a clue. Secondly, don't feed this to me. How dare you pound the Pearl case to me. I got pissed with those jerks at the Wall Street Journal who wanted their friends in the Press to white wash the pictures and NOT use the "Beheading word on TV or in print". Remeber Higgins? He got prime-time for his hanging for a month.
BTW I have no simpathy for Terrorist, since I have chased bad-guys for 20 years. I do have a problem when we do not do things equally and trash the Constitution which I hold dearly. Either read all my post or you give me a break,
