60-40 Senate Votes to Stomp out Freedom of Speech

In direct and wanton violation of their oaths of office, sixty U.S. Senators just voted to squash the First Amendment to the Constitution.

sixty U.S. Senators just voted to squash the First Amendment to the Constitution.

And one of them was Zell Miller. Hopefully this will serve to end the ridiculous speculation and drooling that he might join the GOP.

No, that is not possible. It would call for an advisory opinion, and courts may not do that.

There is a procedure for a 'declaratory judgment', however. A suit for declaratory judgment can be filed whenever a controversy is deemed ripe for judicial determination. In my opinion, such a suit can be filed as soon as this particular bill becomes law, but not before.

Remember this: If Bush vetoes the bill it will keep coming back. If SCOTUS rules the law unconstitutional, then that is the end of it.

I predict the media will quietly say "look what the Senate did" and be otherwise very very quite.

It didn't take one minute after it passed for CNN to announce it under Breaking News. Jude Woodruff could hardly contain her glee.

Congress adjourns Monday. They will not reconvene until April 5. A pocket veto is possible.

Did the House already agree on final passage?

I would agree with you IF there was a provision in the law to kill the WHOLE thing if ANY of it was found unconstitutional.. the fact of the matter the Senate FAILED to include that provision.. therefore on that ground I encourage President Bush to VETO !!

This is an excellent reason to abolish the 17th amendment and return to the origional constitution whereby the State officials appoint the senators to represent the individual states rather than political parties.

Bush will veto it, after all during the election he looked us right in the eye and said he would veto any CFR bill what would ever come to his desk if elected president! I just hope W wasn't lying to us! Lets remind him of his vow!!

Are you saying (# 167) that SCOTUS can declare some tiny little detail of this law unconstitutional and leave the rest alone, which could mean this thing traversing our wonderful court system for years and years with suits and appeals over every little tiny detail? Grrrrh!

Congressman Billybob indicated Bush will do something...based on his inside info...that is not a veto, but something we would like. He gave a hint that it is something which the president can do, but never has before on a bill. He gives me some hope....but still we need to Freep Bush.

ABSOLUTELY!!... that is WHY the only option here is a VETO.. President Bush would lose very little "politcal capital" if he REQUIRES that the an ALL or NOTHING clause be written into the bill... of course the Democrats would view that as a "poisen pill" and quit talking about it (knock on wood)...

Thanks. According to this rollcall, I noted two Rats (Breaux, Nelson) who actually voted the right way on this travesty. Which means there are 11 RINO traitors if my math adds up.

It goes without saying that these Senators are below disgust on this issue (and, in most cases with these Senators, most cases).

But for the GOP bashers here, let's note ONE THING:

not ONE "BLEEPING" DEM SENATOR, INCLUDING GOOD OL' ZELL MILLER, voted against this bill.

So clearly the Republicans were 40/49 on the "right" side and the Dems were 0/51 on the WRONG side. Obviously, there is only one party worth supporting here, and it is our job to get the unconstitutional lunatics OUT of that party, which should be fairly easy.
