And one of them was Zell Miller. Hopefully this will serve to end the ridiculous speculation and drooling that he might join the GOP.
No, that is not possible. It would call for an advisory opinion, and courts may not do that.
There is a procedure for a 'declaratory judgment', however. A suit for declaratory judgment can be filed whenever a controversy is deemed ripe for judicial determination. In my opinion, such a suit can be filed as soon as this particular bill becomes law, but not before.
Remember this: If Bush vetoes the bill it will keep coming back. If SCOTUS rules the law unconstitutional, then that is the end of it.
It didn't take one minute after it passed for CNN to announce it under Breaking News. Jude Woodruff could hardly contain her glee.

I would agree with you IF there was a provision in the law to kill the WHOLE thing if ANY of it was found unconstitutional.. the fact of the matter the Senate FAILED to include that provision.. therefore on that ground I encourage President Bush to VETO !!

But for the GOP bashers here, let's note ONE THING:
not ONE "BLEEPING" DEM SENATOR, INCLUDING GOOD OL' ZELL MILLER, voted against this bill.
So clearly the Republicans were 40/49 on the "right" side and the Dems were 0/51 on the WRONG side. Obviously, there is only one party worth supporting here, and it is our job to get the unconstitutional lunatics OUT of that party, which should be fairly easy.
