Remember this: If Bush vetoes the bill it will keep coming back. If SCOTUS rules the law unconstitutional, then that is the end of it.I would agree with you IF there was a provision in the law to kill the WHOLE thing if ANY of it was found unconstitutional.. the fact of the matter the Senate FAILED to include that provision.. therefore on that ground I encourage President Bush to VETO !!

Are you saying (# 167) that SCOTUS can declare some tiny little detail of this law unconstitutional and leave the rest alone, which could mean this thing traversing our wonderful court system for years and years with suits and appeals over every little tiny detail? Grrrrh!

NORMALLY, when the Supreme Court strikes some provisions of a law that has a severability clause, the rest of the law stands as written. Notice I said "normally." There is a way to get the entire bill struck when only some portions of it are declared unconstitutional. In fact, there are two routes to that highly desirable outcome. Both will be in my brief to the Supreme Court, IF this bill becomes law.
