Trump-appointed judge blocks Alien Enemies Act deportations in Los Angeles area

A judge in California on Monday blocked the Trump administration from using the wartime Alien Enemies Act to deport Venezuelan migrants in the Los Angeles area, ruling that the government hasn't promised adequate due process.

The ruling by U.S. District Judge John Holcomb — who was nominated by President Trump in 2019 — is the latest to limit the administration's controversial practice of rapidly deporting people accused of being members of the gang Tren de Aragua under the 1798 law, which allows removals during an "invasion" or "predatory incursion" of the United States. Courts in three other states have also blocked Alien Enemies Act removals, though under different arguments...

Judges protecting the guilty as usual.

I wish I had been wrong about being totally contemptuous of the judicial system all these years.

But now others have gravitated to my cynicism. Sad.

1. The judge is not blocking the use of the Alien Enemies Act as justification for the removals. The judge is saying even with the use of that act as legal basis for the removals, that more due process than was given by the administration is required.

2. However, the judge should also give an immediate stay of his own order, letting the appeal process go forward, because any nationwide ruling should come from SCOTUS, and putting a stay on his own order would leave the enforcement of that order in abeyance until SCOTUS rules on a final appeal.

3. If SCOTUS backs up this judge, with most of the SCOTUS Conservatives in the majority, then this would be another case not where Trump’s goals are wrong, or where he picked bad judges himself in his first term, but where he is getting bad legal advice on what matter of law can be used to justify the means used for his goals.

The enemey wants to delay, delay, delay and run out the clock on Trump second term. Expedited removal was always going to cause a judicial war. If we lose then at least its on the record. Playing by business as usual rules against violent Democrat Marxist is always going to be a guaranteed loss because they observe no rules.

Faulty logic and faulty reasoning. Elementary fail. By the same logic, a murderer, or rapist or any other criminal does not deserve due process because they did not follow due process and instead allowed their animal nature to take over?

It’s not a statute; it’s in the Constitution.

Even Clarence Thomas has strongly supported “Procedural Due Process,” which means every person has the right to know the exact charges they’re facing, and has a meaningful opportunity to present their own response.

If the immigration courts hadn’t be gutted, we’d have immigration judges in place to provide those 5-minute hearings and comply with the Constitution.

That is one thing, at the end, SCOTUS is going to have to decide on.

My point on none of this is about the goals. In law quite often it is not the goal/intent that is to be questioned, it’s the means, and that means “the means available under the law”.

I applaud Trump’s goals on many things. I do think he is getting bad legal advice on what laws provide the best legal justification for various actions, and it is on those questions, the laws, the legal challenges have arrived.

Some of this is novel and even some Conservative judges are unsure about the means - legal means - being used, no matter what they might agree about the goals.
