Trump doesn’t bloody threaten vetos for anything. If they don’t want the government shutdown veto IS how you get this done. Veto any bill that doesn’t balance. Trumps biggest weakness is his fear of being blamed for a shutdown. I defer to him with this CR but going forward he needs to be ready to veto and shut things down unless all of the doge cuts are passed into law.

Figures one of the few high profile Republicans speaking out on the Judicial insurrection would be someone who cannot do anything about it. We have the Senate and the House but they do nothing

This remedy has been brought up before. In theory, it’s a great idea. But getting it through Congress is and always has been the rub. If this solution would require a 60 vote majority in the Senate, then it’s as dead in the water as judicial impeachment is.

“Congress has the authority to strip jurisdiction of the federal courts to decide these cases in the first place,” DeSantis wrote.

U.S. Constitution, Article 3, Section 2:

Section 2.

The judicial power shall extend to all cases, in law and equity, arising under this Constitution, the laws of the United States, and treaties made, or which shall be made, under their authority;--to all cases affecting ambassadors, other public ministers and consuls;--to all cases of admiralty and maritime jurisdiction;--to controversies to which the United States shall be a party;--to controversies between two or more states;--between a state and citizens of another state;--between citizens of different states;--between citizens of the same state claiming lands under grants of different states, and between a state, or the citizens thereof, and foreign states, citizens or subjects.

In all cases affecting ambassadors, other public ministers and consuls, and those in which a state shall be party, the Supreme Court shall have original jurisdiction. In all the other cases before mentioned, the Supreme Court shall have appellate jurisdiction, both as to law and fact, with such exceptions, and under such regulations as the Congress shall make.

The trial of all crimes, except in cases of impeachment, shall be by jury; and such trial shall be held in the state where the said crimes shall have been committed; but when not committed within any state, the trial shall be at such place or places as the Congress may by law have directed.

Congress can certainly strip the appellate jurisdiction of the Supreme Court, and has done so in the past, notably in the civil war era. In Ex parte Milligan, 71 U.S. 2 (1866) the government suffered a 9-0 defeat. In Ex parte McCardle, 74 U.S. 506 (1868), after the case was heard by SCOTUS, but before it was decided, Congress stepped in to take away the appellate jurisdiction of the Court to prevent them from issuing a decision.

I would like to see DeSantis or somebody define "these cases" for which the courts would be stripped of jurisdiction.

I've got an idea. Make believe there is a real war against Tren de Aragua and declare martial law until the "war" is over. Like the civil war. Under martial law, the civil courts close up shop until martial law is lifted.

He knows whereof he speaks. He is as a JAG (with top of the line legal background from Yale). Like Vance, he’s from a very modest family in the Jacksonville area…dad was an AC repair guy, if I recall correctly, but de Santis got scholarships and then the military program.

Like Vance he’s brilliant on the Constitution and US history.

I hope Trump listens to him. I don’t think Bondi is aggressive enough.

The Commander-In-Chief role to defend and protect the homeland, from foreign adversaries, is bait.
Branch warfare by a local judge in a dress.

Is Branch warfare an insurrection?

Too outrageous for words.

What if Trump should fire this activist judge? Monkey see, monkey do.

As soon as Trump disposes of this stupid but historic case the judicial overreach between separate-but-equal Branches, will force a look at the Commander-in-Chief role.

A judge directs missiles and troop movements. Why not?
