Trump throws down the gauntlet to the out-of-control federal district court judges *UPDATED*

On Tuesday, Trump issued a memorandum entitled “Ensuring the Enforcement of Federal Rule of Civil Procedure 65(c),” and directed it to “the heads of executive departments and agencies.” The order opens by describing the way activists, using donated and government-granted funds, have been obtaining sweeping injunctions from carefully selected district court judges (that is, those seated in forums friendly to Democrats). With the judges’ help, the activists have been ” functionally inserting themselves into the executive policy making process and therefore undermining the democratic process.”

...it’s mandatory, although the government never seems to have bothered pushing for security before:

The court may issue a preliminary injunction or a temporary restraining order only if the movant gives security in an amount that the court considers proper to pay the costs and damages sustained by any party found to have been wrongfully enjoined or restrained. The United States, its officers, and its agencies are not required to give security. (Emphasis mine.)

In other words, while the court has discretion about whether a preliminary injunction or temporary restraining order is appropriate, once it makes that determination, it must require that the plaintiff provide security.

Trump states that, moving forward, the government’s new policy is that it will “demand that parties seeking injunctions against the Federal Government must cover the costs and damages incurred if the Government is ultimately found to have been wrongfully enjoined or restrained.” He instructs the heads of executive departments and agencies to ensure that they make this request to the courts every time.

I cannot understand why this has not been done all along as a matter of course.

Also, to defeat the left's shopping for favorable judges, the administration should file declaratory judgment actions in sympathetic districts just as soon as it gets word that any leftist group intends to sue.

A good move. But some of these leftist judges need to be impeached and kicked off the bench IMHO.

Trump could get a legal opinion from the White House attorney that the activist judges do not have standing or jurisdiction or whatever. Then the Executive Branch can ignore the judges while the activists appeal up to the Supreme Court.

In reverse positions, Democrats would do something like this.

This needs to be stopped. These so called “judges” are out of control. They need to get their asses back in their own lane. Civil Service Human Resources is not their yob mahn.

I think it probably is Because no one had the guts to face the machine of the left before.

Schumer wasn’t joking when he cautioned agaisnt mucking with the fbi- the left own and control a great deal of powerful entities, social media, the fbi, cops, courts, msm, businesses, antifa, blm who do the dirty work, soros controls a lot too. Noone has had the guts and patriotism that pres Trump has and the resolve to correct f great injustices and face great corruption head on before.

Pres Trump is not going to let corrupt politics lord it over him. Nor is he going to cower and shrink from it. He proved that when the left tried to assassinate him and he defiantly and patriotically rose to his feet and shouted to the crowd “Fight! Fight! Fight!”

Pres Trump is the exact right president for the exact right time, and now it is time for the corrupt to reap the whirlwind of justice- true justice that is!

Lets do this instead… Schumer once said the FBI DOJ CIA have till Sunday to find the crime. Show me the man and I’ll find you the crime. Bondii and kash need to investigate those corrupt judges and bring them to justice even if it’s for a parking ticket! Show them no mercy!

With multitudes of local and regional judges, any one of this throng can throw a monkey wrench into the works. Even if it goes all the way to the Supreme Court, after the Court rules, the same situation can start all over again.

I’m not sure what the best answer to this is, but it definitely has the possibility of making the system nonfunctional. I don’t know what the best answer is, but a long-term solution needs to be found.
