Federal judge to hear arguments in suit aiming to stop Trump's birthright citizenship order

GREENBELT, Md. (AP) — A federal judge on Wednesday is set to hear arguments over temporarily pausing President Donald Trump's executive order seeking to end birthright citizenship for anyone born in the U.S. to someone in the country illegally.

Trump's inauguration week order is currently on temporary hold nationally because of a separate suit brought by four states in Washington state, where a judge called the order “blatantly unconstitutional." In total, 22 states, as well as other organizations, have sued to try to stop the executive action.

U.S. District Judge Deborah Boardman is set to hear arguments in Maryland federal court. Bringing the suit before Boardman are immigrant-rights advocacy groups CASA and Asylum Seeker Advocacy Project, and a handful of expectant mothers.

At the heart of the lawsuits is the 14th Amendment to the Constitution, ratified in 1868 after the Civil War and the Dred Scott Supreme Court decision that determined Scott, a slave, wasn't a citizen.

Getting it into the court is the thing. Move it up the chain to SCOTUS.

Only a matter of time before “birthright citizenship” as defined by Democrats is dead and buried, imo.

Why don’t we just skip the song and dance and send this directly to SCOTUS? Stringing this out will just allow more wetbacks to drop anchor babies,,,guaranteeing the kid *and* the mother to stay forever.

This is how it gets to SCOTUS for clarification. I expect this court will highlight the problems, fix the birth tourism problem with a half way ruling and give a strong message that congress needs to do the clarifications in law with illegals/undocumented. Blocking citizenship when mom is on a tourist visa is what we can expect out this court, unless one of the liberals stepped on a human turd on the metro that morning and agree to the flat reading and cause mass chaos.

Honestly for this issue I am not even gonna bother what the lower courts do, this is going to SCOTUS and everything else is nothing more than Kabuki theater.

Another liberal Feral “judge” thrown onto the DNC “judge” heap by Joe Pedo. She needs to recuse herself. She doesn’t really look like she knows much about the Constitution. It’s a waste of time to take this important case up if it’s run by a chimp who has already made her mind up. It’s as worthless as these cabinet hearings being held by the perverted far-left chimp Senators. After Joe Pedo’s nomination, Boardman was confirmed by a vote of 52-48. Not good.

Federal judges nominated by Joe Biden On April 19, 2021, President Joe Biden (D) nominated Boardman to the United States District Court for the District of Maryland. She was confirmed by a vote of 52-48 on June 23, 2021. She received commission on June 25, 2021.

Agreed. The 14th amendment, and it’s original intent, is clear and the current stance on ‘birthright’ is unconstitutional.

Only two Republicans voted to confirm Judge Boardman. They were Susan Collins and Lindsay Graham. Even Mitt Romney and Lisa Murkowski voted nay on this one.

How do any of these people get "standing" to sue? Expectant mothers who are illegal aliens should not have standing for two reasons.

Firstly, because they are illegal aliens.

Secondly, because they have not yet been "injured" and therefore have no cause of action against the government.

But the law is a very silly place, and it is best to avoid going there if you can.

I suspect taking it to the courts will do the same thing. They have been grossly misled and brainwashed on the subject, and all of them are likely to decide the 14th amendment creates the most idiotic result for the nation.

Wong’s parents weren’t illegal aliens. This old tactic won’t work for them. The intent of the 14th is clear despite a bad politically driven SCOTUS decision from the late 1800s.

Anyone with half a brain knows this will go to the Supreme Court. I’ll be up to the USSC to interpret the meaning of “subject to the jurisdiction of thereof” in the 14th Amendment.

I hope they take it to mean that citizenship should be more than just being born here, that only children of parents who are here legally should be given citizenship by birth.

Full disclosure. My daughter was born in England while I was stationed there. She has a British birth certificate and a document from the State Department called a “Certificate of Birth Abroad”. That document proves she is a U.S. citizen, but I think the British birth certificate would mean that she is also a citizen (subject really) of Britain if she so chose, but she won’t. One big difference to anchor babies: I was in England legally at the invitation of the British government. I didn’t sneak in.

I agree. There is no such thing as "birthright citizenship." It's something the RATS created to suit their need to get, and retain power. And as always, the gutless Republicans let them get away with it.
