California judge: first grader too young for free speech rights, family appeals

The mother of a first grader punished for handing an “innocent” drawing with the phrases “black lives matter” and “any life” to a classmate of color is appealing to the Ninth Circuit Court of Appeals after a lower court ruling declared first-grade students are too young to be protected by the First Amendment.

After a first grade lesson on Martin Luther King Jr. and Black Lives Matter, a student who felt bad for her classmate of color drew a picture for that classmate to allegedly help the classmate feel more included. The picture had the phrase “Black Lives Mater” (sic) above “any life,” with a picture below of four circles of different colors — which the author says represented her and three classmates holding hands. The student thanked the author for the drawing and took it home, after which the recipient’s mother reported the drawing to the school’s principal “to express concern that her daughter was being singled out for her race.”

The school’s principal, Jesus Becerra, allegedly concluded that writing “any life” was “inconsistent with values taught in the school but acknowledged that [author’s] motives were ‘innocent.’” The recipient’s parents agreed the author innocently drew the picture and that they did not want the author punished, but Beccara allegedly declared the drawing “racist” and “inappropriate,” and submitted the first-grade author to punishment.

Another of a thousand reasons to home-school your child. I cannot comprehend the stupidity of the adults in this situation.

Too young to be afford free-speech protection;
not too young for indoctrination.

But California, by its own twisted laws, can try to change the gender of your child and not inform you as a parent.

No free speech till the kid says, “I am a cat.”

the recipient’s mother reported the drawing to the school’s principal “to express concern that her daughter was being singled out for her race.”

The problem here started with the recipient's racist female canine mother ...

The First Amendment is very short. It doesn’t mention anything about age restrictions.

“which the recipient’s mother reported the drawing to the school’s principal “to express concern that her daughter was being singled out for her race.”

Wow, amazing what race baiting has gotten. This was totally innocent, and how many times have we heard someone identifying themselves as a “person of color”

Also from the article: “Becerra forced the author to apologize to the recipient for the drawing — to which the recipient allegedly expressed confusion upon receiving, leading to more confusion from the author. He also banned the author, a student “who loved to draw,” from drawing and giving pictures to classmates, and teachers banned the author from recess for two weeks without telling her why.”

first-grade students are too young to be protected by the First Amendment.

So a first-grader has no right to attend church? A first-grader has no right to peaceably assemble at a playground?

After I was accused to HR by a black employee of “incorrect political thought” I was advised by HR to never speak to that guy again. If I did, I was told they “Couldn’t ignore another complaint.” To say I was stunned under plays my feelings. We had an innocent conversation, and I had no idea he was upset. But the accusation was incorrect political thought. The upshot was because any black could ruin the reputation of or get fired any white, I never spoke to another black I hadn’t known for years.

If you’re in school or at work or in the gym, my advice is avoid any contact with a black you don’t know as it’s very dangerous. They have done this to themselves.

Over the years at work, I had managed to get numerous employees recognized for outstanding performance. I’d put some up for cash awards. That all ended with the one accusation. I’ve never felt so “1984.”

Only by attending law school could you come up with such a moronic idea. The Constitution nowhere mentions age except as a qualification for office.

Considering that BLM has proved to be a anti white black mail fraudulent con, perhaps all lives matter isn’t racist at all. It is child abuse to punish this child. Every educator involved in this travesty should be banished for life.

ANOTHER REASON TO HOMESCHOOL

This ping list is for the other articles of interest to homeschoolers about education and public school. This can occasionally be a fairly high volume list. Articles pinged to the Another Reason to Homeschool List will be given the keyword of ARTH. (If I remember. If I forget, please feel free to add it yourself)

The main Homeschool Ping List handles the homeschool-specific articles. I hold both the Homeschool Ping List and the Another Reason to Homeschool Ping list. Please freepmail me to let me know if you would like to be added to or removed from either list, or both.

So basically, they want to raise then kids thinking they don't have the right to free speech so when they're adults, they'll be used to the thought and accepot that right taken away.

By this logic a child developing in the womb is too young to be granted life (liberty and the pursuit of happiness). Must be a Democrat.
