The Heritage Oversight Project has identified three swing states – Georgia, Nevada and Wisconsin – where they believe removing Biden from the Democratic ticket would prevent anyone else from replacing him.
Wisconsin does not allow withdrawal from the ballot for any reason besides death, while in Nevada, no changes can be made to the ballotafter 5 p.m. on the fourth Friday in June of an election year unless ‘a nominee dies or is adjudicated insane or mentally incompetent.’ In Georgia, if Biden were to withdraw less than 60 days before the election, his name would remain on the ballot but no votes would be counted.
According to a draft from The Heritage Oversight Project obtained by the Daily Mail:
Three of the expected six most contested states have some potential for pre-election litigation aimed at exasperating, with legitimate concerns for election integrity, the withdrawal process for a presidential candidate.
GA, NV, and WI, have specific procedures for withdrawal of a presidential nominee with differing degrees of applicability and timelines.’ WI does not allow withdrawal for any reason besides death.”

This is, of course, the problem. There is always a way around inconvenient laws for Democrats.
It is my understanding that the courts would allow those state laws to be broken. Parties get to decide their nominee and will be allowed on ballots everywhere.
LOL. All they need is a friendly judge. Remember when they replaced a Senate candidate who was a criminal, and the courts allowed it in the “ interest of democracy”.

All three of those courses of action lead to Democrat defeat. Literally, they have done every stupid mistake they could make, including accidentally forgetting the law in Ohio which states they can’t have anyone on the ballot who isn’t the certified candidate of the party by a certain date. So, they scheduled their conference to appoint Biden the candidate too late. Ooops.
I just hope the Secret Service agents assigned to Trump (and his own personal security) all are loyal to America, and not the DNC.
That’s real close. Nevada, Georgia and Wisconsin all have that same rule. And they still haven’t found a way to legally get him on the ballot in Ohio because the idiot party scheduled their conference too late to get him on the ballot and the Republican governor and Republican legislature is showing balls of steel by refusing to budge.

Assuming this applies to Presidential elections that would set the date by which Biden could withdraw and still take his name off the ballot as Sept. 6, 2024
What is being discussed is simply nominating someone else in place of Biden at the Democratic National Convention, which is being held from Aug 19 to 22. The nominee will be communicated to the State of Georgia after the Convention has nominated him.
Sadly the claims that these States have laws that somehow make it hard to swap out Joe are FALSE.
There are no legal or calendary based impediments to the Democratic Party nominating someone other than Old Joe at their convention.
There may be Convention rules that prevent it. Several people have said that there is no way they can nominate someone else if Joe wants to stay in the race. (Those primary votes are binding for the first round balloting under the DNC rules.) But assuming Joe bows out, it's really business as usual for the Dems to pick someone else and communicate that to the States.
Trying to have Joe drop out AFTER the convention would be a whole different thing, and that is probably impossible.
So the window for dumping Joe is open until Aug 22 when the convention ends, but does probably require his agreement.

They had a special legislation session, but no word yet on whether they voted to violate their own laws.
You are correct. There is not yet a Democrat or Republican nominee yet...therefore this cannot yet apply. Biden is not being withdrawn yet from any ballot because he hasn’t even been nominated yet.
