Trump Lawyers Ask Judge to Dismiss Documents Case Over Moved Evidence

Prosecutors have contended that even though materials were reordered, the boxes still contain the same evidence as when they were taken from Mar-a-Lago.

Former President Donald Trump this week filed a motion to dismiss his classified documents case, claiming that officials altered exculpatory evidence.

Prosecutors several weeks ago disclosed that the order of materials inside boxes of evidence was moved around.

A motion filed by his attorneys late on June 10 asks U.S. District Judge Aileen Cannon to scrap the case, which alleges that the former president illegally hoarded classified and top secret materials after leaving office in early 2021.

The “original order of documents within the boxes” was not preserved after they were obtained, the motion says.

“There are no photographs or logs documenting the nature in which the allegedly classified documents were commingled with personal effects and out of plain view,” his attorneys continued, adding that the evidence ”was materially exculpatory” about allegations that President Trump violated the Espionage Act.

I wasn’t able to read the article without prescribing so I don’t know if the article answers my question but I’ll ask it here in case somebody know the answer.

My understanding is that they put placemarkers that they claimed described the documents but when they wanted to put the documents back in their order they couldn’t tell which document the placemarker was describing because in some cases there weren’t any documents that matched the description.

Am I misunderstanding?

It’s not going to happen sorry to disappoint. Even this judge is corrupt and under the DOJ lawfare strings of the DC swamp judicial branch Cabal ….she ain’t gonna dismiss nothing. I for one have lost faith in the judicial system. It’s gone it’s finished.

They would not allow an on scene audit of what they removed from the premises. So once they got it behind closed doors they add anything they wanted.

Accurate, but incomplete. With boxes that contain folders marked declassified and ordinary folders, all that it takes to create a prima facie case of an espionage act violation under the government theory is for the FBI to move a document from a declassified folder to an ordinary folder. And since Trump's attorneys were barred from the scene and place holders not properly identified so as to maintain the original location of a document, such a prima facie case can be created intentionally or even inadvertently with no way to detect if that has taken place.

The cops had to complete a receipt and inventory of everything they seized to make the search legal under their search warrant.

I have read a number of accounts that said no on scene audit was allowed. Would it surprise you to learn they broke protocol and didn’t give a damn about the rule?

The inventory wouldn’t necessarily have the order and placement of every document in every box. It could have said “17 boxes of documents”.

Selective Prosecution is unconstitutional. It’s a constitutional violation.

Did they take classified Folders to Joe Biden’s storage units (tipped off) and take pictures making it look like they were Joe’s?

Did they do that to Pence?

Did they do that to Comey?

Did they do that to Hillary?

Did they do that to Huma?

The Justice Dept designated Hunter Biden’s mugshot as highly secret and locked it down. How about Trump?

I would think that nothing they seized would be admissible then because there is no way to certify chain of custody. They have no way to prove that anything they present was actually in what Trump had seized.

Especially since a bunch of stuff Trump had was actually sent to him by other people. Can’t remember exactly who - if it was the people who were supposed to have packed it up or who. But unless there is something where Trump told the people who were going to pack stuff up for him, saying to take such-and-so specific classified records how would they prove that Trump even knew?

Then again, the accountant testified outright that Trump didn’t tell him how to classify the payments to Michael Cohen either, and several checks weren’t even signed by Trump - and yet they claimed to have proven he was involved.

What a crappy, crooked system we have.

So are they trying to claim that Trump hid classified records in files marked as unclassified?

If so, then this issue of them “misplacing” means that they almost certainly did what they are accusing Trump of doing.
