Arizona voters to decide whether to make border crossing by noncitizens a state crime
CBS News ^ | June 4, 2024

The GOP-controlled Arizona Legislature on Tuesday approved a proposal to ask voters to weigh in on a ballot measure this fall to make it a state crime for noncitizens to enter the state through Mexico at any location outside of a port of entry.

The Arizona measure, approved by the state House on a 31-29 vote, would allow state and local police to arrest people crossing the border without authorization. State judges would also have the power to order people convicted of unauthorized border crossing to return to their countries of origin.

The state House voted along party lines, with all Republicans voting in favor of the proposal and all Democrats voting against it. The measure bypasses Democratic Gov. Katie Hobbs, who vetoed a similar measure in early March and has criticized the effort to bring the issue to voters.

Bragg turned a federal crime (that the feds reviewed and found no basis for prosecution) into a state “crime.”

The same principle applies here.

I approve the goal. But it’s unconstitutional. Feds have sole jurisdiction over immigration.

With the % of non Mexican/ Cen Am/ So Am going way down in favor of Chinese/ Indian/ Pakistani/ Hatian and Africans.

I would guess there is a lot less sympathy for the current illegals than in the past.

Article IV Relationships Between the States

The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence.

When the Federal Government is actually paying for our own invasion you can be damn sure it is Constitutional for the States to defend themselves.

True the feds have authority over immigration.

But it’s also against federal law to just sneak into this country.

I’m sure there will be lawsuits if this passes.

“Feds have sole jurisdiction over immigration.”

True if the perp is at the border. After entering the state the local laws apply.

Texas has already adjudicated this and won.

Not naturalization under Section 1 Article 8.

Invasion under Article III Section 4:

The United States shall guarantee to every State in this Union a Republican Form of Government and shall protect each of the against invasion.

As a republic, each state has the natural power and duty to protect its citizens from invasion.
