Alan Dershowitz Destroys Judge Merchan After Attending Trump Trial

It's no secret that Judge Juan Merchan is a partisan judge who has exhibited prejudicial behavior against Donald Trump in his Manhattan trial, but famed lawyer and law professor Alan Dershowitz had to see for himself. He attended the Trump trial on Monday and was appalled at what he saw.

Dershowitz appeared on Sean Hannity's show on Fox News Monday evening, during which he destroyed Merchan for his conduct during the testimony of Michael Cohen's former lawyer, Bob Costello. It got extremely tense at times, and Merchan even cleared the courtroom before scolding Costello over his alleged violation of decorum.

“I’d like to discuss proper decorum in my courtroom. As a witness in my courtroom, if you don’t like my rulings, you don’t say, ‘Jeez,’” Merchan reportedly told Costello. "You don't give me side eye, and you don't roll your eyes."

While the public was removed for that moment, Dershowitz, who is not involved in the case, was surprisingly allowed to remain.

"I've got to imagine in all the years you practice law, have you ever seen anything like this?" Hannity asked.

"No, I never have," Dershowitz replied. "I sat in the front row, literally just feet away from where all the action occurred. I rolled my eyes when the judge made some rulings that were absurd. Any first-year evidence student would understand that he was making biased rulings in favor of one side."

"I stared him down, but Costello didn't," Dershowitz continued. "He acted like a normal witness, and the judge went berserk. The judge violated Trump's constitutional right to a public trial by kicking the media out of the courtroom. I don't know why I wasn't kicked out, and I heard him lecture Costello…

Some on the left approve of Cohen's larceny (and of course he won't be charged for it).

I wonder if Cohen ever studied ancient history, because Themistocles did something similar in 480 B.C.

The Greeks were terrified by the Persians and wanted to withdraw to the south, but the Euboeans wanted them to stay long enough for them to get their families to safety, so they bribed Themistocles 30 talents. Themistocles gave 5 talents to the Spartan commander Eurybiades and 3 talents to the Corinthian commander Adeimantus, as if it were his own money, and kept the rest of the Euboean bribe for himself.

One can only imagine the promises made to the corrupt prosecutors, judges, special counsels, etc. This whole sham has been a criminal conspiracy all the way to the Oval Office. RICO was designed for just this type situation; however, it was never contemplated that those responsible for prosecution will be the ones committing the crimes.

My question is, since this trial clearly violated Trumps federal civil rights, can he make his appeal directly to the Federal Court system?

I think a directed verdict would be issued by the judge before the case went to the jury. In an extreme case, a judge might overrule a guilty verdict in favor of the defense.

I have never heard of a case where a jury returned a “Not Guilty” verdict and was overruled by the judge. That sounds about as unconstitutional as anything King George III could have dreamed up.

I think the judge can do that in a civil, but not criminal case.

But we are in a new era, one of evolving law, and Merchan is the legal Darwin.

They’re finding out that, thanks to the feckless GOP, they can get away with anything short of public murder.

We are in the grip of some very evil people. There is nothing they won’t say or do to have their way. This country and its citizens are of no value to these people. The media and the GOPee cover for them and I’m convinced that if given a chance, Merchan will give Trump an unimaginable prison sentence and make him stay in jail until his case is heard on appeal, if he can get an appeal.

Let’s be honest. The reason any of this is happening is because you, me, all of us are hated by a significant segment of the population. These are people for whom ‘winning’ (= forcing their will on all of us they hate) is everything and 100% justifies anything and everything they can do to win - legal or illegal, moral or immoral, honest or dishonest. They have no moral boundaries. None. They will take every opportunity presented to them to further their agenda - irrespective of who gets hurt and what happens to the nation.

Couldnt agree more. Marchand is a disgrace to the judiciary. But he reads the papers and he knows it is all but a universal opinion, left and right, that this case is a dog that needs to be taken out and given the Noem treatment. It cannot stand on appeal, and he could very well end up getting his knuckles rapped pretty hard by either of the two levels of appellate court. He knows just one juror of integrity could result in having to do the whole mess over again. He’s been brutal to Trump and committed all sorts of error just to benefit the prosecution. Granting the directed verdict would avoid all that. He can spend all weekend writing a decision that excoriates Trump and mournfully recounts the inability of the prosecution to prove the case. I’m going to reiterate my prior prediction on this forum of a 15-20% chance he grants the motion; it’s the perfect off ramp in a situation where he needs one

All Federal Judges go in for training at what is called The Baby Judge’s School before being assigned cases. Part of the curriculum is designed to prepare them for highly publicized trials like this, with actors playing the role of difficult witnesses and argumentative counsel. Sure, there are a boatload of cranky, temperamental, and excentric Federal Judges and Magistrates, but you never see one as inept at courtroom decorum as this judge is.

Not directly, but could by writ of certiorari to the USSC. Or Trump could file a 42 USC 1983 civil multiple count claim for violation of civil rights under the color of authority against NY State, this Judge and anyone else who contributed to this illegitimate persecution

Merchan is only there to pronounce Trump “guilty”.

The Socialist Democrats know full well this joker will be reversed on appeal. They just want to convict Trump for the election,
