Kyle Tate is charged with grand theft and criminal mischief...
A Palm Bay, Florida Homeowners Association board member was arrested last month after allegedly pulling a gun on three kids fishing at a lake in his subdivision, taking their equipment and throwing the rods, reels and tackle into the woods..
Police charged 57-year-old Kyle Patrick Tate with criminal mischief and grand theft as a result of the incident.
A court affidavit filed in Brevard County, Florida alleges that on April 14, officers with the Palm Bay Police Department were dispatched to a suspicious incident at Stillwater Lakes, a subdivision owned and managed by an HOA.
FOX 35 in Orlando confirmed Tate is the president of the community’s HOA.
...
The responding officers spoke with three kids who were fishing on the south side of the lake in Stillwater Lakes, who said a man, later identified as Tate, walked up to them while holding a firearm and telling them to get off his property.
But the property belonged to the HOA, not Tate, according to police.
Still, Tate grabbed their fishing rods, reels, tackle boxes and other equipment, before throwing the equipment into the woods and damaging them.
...
The kids told police they estimated the fishing rods and reels to be valued at $1,900; the tackle boxes and lures inside to be valued at $150; and cast nets to be valued at $150.
Tate also allegedly took a phone valued at around $1,500 from one of the kids, which has not yet been recovered,

The public ethos of entitlement now eclipses any and all property claims unless you are prepared to shell out to take trespassers to court. It’s a travesty.
Yet m accused of being a terrible person because I want to enforce rules and property rights on FR
Very true. The popinjays tend to run off any board volunteers with actual expertise who want to serve others and see that things are done by the book. It's so easy; all you have to do is call them racist.
It's just that what seems a narrow sphere to them can actually ruin an individual owner's life.
The article does not explicitly say one way or the other, but has anyone considered that those kids might live there, or are visiting relatives/friends, and were thus not trespassing at all?
Thanks! Very clarifying--possibly more so than you had planned.
Why? On first reading, in the context of the "fishing-tackle-versus-gun" incident, I thought you were talking about human beings. That made perfect sense, in the context of "older males" chasing out "younger males."
Scary about the 'gators. I guess if you live down there, you pay attention to the season when you go anywhere near water!
A number of years ago, a northern family was staying in a onsite Disney Hotel in Orlando, Florida, they decided to take a walk along one of the lakes at Disney, their kid was barely in the water when a Gator attacked and drug the kid into the lake and ate him.
Here’s an article from the Washington Post about the incident, alligators despite Disney’s best efforts still proliferated in their lakes and attacked a young boy killing him.
Disney settled the case quietly, in a small HOA that would ruin the neighborhood and yet, I’m told how terrible I am for trying to enforce rules and property rights.
“Why do so many HOAs turn into oppressive tyrannies?”
For the same reason too many sadists are attracted to law enforcement. They get off on controlling and torturing other people and when entrusted with power and authority they indulge in it.
Hmm.... too soon to start with the lawyer jokes?
This AH is a lawyer?
That fits perfectly...
No, stupid is locking yourself out of your car or believing what the corrupt in government tell you. Pulling a gun on someone can get you killed and thrown in prison. This dangerous assh*le needs a serious mental evaluation.
He was a lawyer?
Methinks he was trying to impress his mistress. Probably drugs and alcohol were involved.
Just a SWAG.

Btw, this says a lot about people who live in HOAs. If they can’t control your every move, they want to kill you.
Brandishing = pulling a gun on kids fishing , then stealing their equipment on HOA / not on his personal property, and ... Possible - those kids might live there, or are visiting relatives/friends, and were thus not trespassing at all?
Gee. I am shocked.
Call it whatever makes you feel okay, the central point of my argument is sound and correct.
You can’t seem to distinguish between someone with a serious mental issue and one who makes a simple understandable mistake, so no, you have very little sound credibility.
And you can’t seem to distinguish between rules and property rights. Your words mean nothing to me, I don’t live my life worried about someone anonymous person on FR rants about.
I never said a word about private property. Read back slowly this time.
I said a person who threatens young people with a gun, young people who are simply fishing, is dangerous and has very serious mental issues.
